Washington, DC 20502 Dear Mr. President: We urge you not to make the decision to deploy an anti-ballistic missile system during the remaining months of your administration. The system would offer little protection and would do grave harm to this nation's core security interests. We and other independent scientists have long argued that anti-ballistic missile systems, particularly those attempting to intercept reentry vehicles in space, will inevitably lose in an arms race of improvements to offensive missiles. North Korea has taken dramatic steps toward reconciliation with South Korea. Other dangerous states will arise. But what would such a state gain by attacking the United States except its own destruction? While the benefits of the proposed anti-ballistic missile system are dubious, the dangers created by a decision to deploy are clear. It would be difficult to persuade Russia or China that the United States is wasting tens of billions of dollars on an ineffective missile system against small states that are unlikely to launch a missile attack on the U.S. The Russians and Chinese must therefore conclude that the presently planned system is a stage in developing a bigger system directed against them. They may respond by restarting an arms race in ballistic missiles and having missiles in a dangerous "launch-on-warning" mode. Even if the next planned test of the proposed anti-ballistic missile system works as planned, any movement toward deployment would be premature, wasteful and dangerous.

An Open Letter To the U.S. Senate: We urge the Senate to oppose the passage of the pending U.S. Senate Bill S. 507. We hold that Congress, before, embarking on a revision of our time tested patent system, should hold extensive hearings on whether there are serious flaws in the present system that need to be addressed and if so, how best to deal with them. This is especially important considering that a delicate structure such as the patent system, with all its ramifications, should not be subject to frequent modifications. We believe that S. 507 could result in lasting harm to the United States and the world. First, it will prove very damaging to American small inventors and thereby discourage the flow of new inventions that have contributed so much to America's superior performance in the advancement of Science and technology. It will do so by curtailing the protection they obtain through patents relative to the large multi-national corporations. Second, the principle of prior user rights saps the very spirit of that wonderful institution that is represented by the American patent system established in the Constitution in 1787, which is based on the principle that the inventor is given complete protection but for a limited length of time, after which the patent, fully disclosed in the application and published at the time of issue, becomes in the public domain, and can be used by anyone, under competitive conditions for the benefit of all final users. It will do so by giving further protection to

HERBERT HAUPTMAN is the only nonchemist to have ever received the esteemed Nobel Prize in Chemistry. He is also the first alumnus to be so honored. Hauptman received the 1985 Nobel Prize for inventing a revolutionary method of determining the three-dimensional shapes of molecules, which holds significance for drug research worldwide. Solving the problem that had perplexed chemists for 40 years, Hauptman's "direct methods technique" enables researchers to design new drugs to combat such health threats as heart disease, cancer and high blood pressure. While a doctoral student in mathematics, he worked at the Naval Research Lab (NRL) with Jerome Karle, whose expertise in physical chemistry complemented Hauptman's mathematical base. By the time Hauptman earned his doctorate in mathematics, the two had completed the bulk of the research that netted the pair the Nobel. Hauptman worked as a physicist-mathematician at NRL from 1947 until 1970, heading various divisions, when he left to head the Mathematical Biophysics Lab at the Medical Foundation of Buffalo (N.Y.) Inc. Today, he is president of the Hauptman-Woodward Medical Research Institute Inc. as well as research professor at SUNY Buffalo. Hauptman's lifelong research in crystals has an artful correlative. His avocation is creating stained glass constructions in exquisite geometric patterns.
