This site reprints Mr. Spooner's 1845 book, Unconstitutionality of Slavery Prior to the 1861-1865 War, there were a number of abolitionists who opposed slavery. Nowadays, their reasons for doing so are generally unknown. This series of websites educates by making the text of those old abolitionist writings accessible. Whether or not you agree with their legal position, it is at least a good idea to know what were the views of these abolitionists! These abolitionists included William Mansfield John Adams (pre-1776), Samuel May Salmon P. Chase George Mellen Alvan Stewart ... Edward C. Rogers (1855), and Frederick Douglass These abolitionists showed that pursuant to common law precedents constitutional law bill of rights ... anti-kidnaping law , and other legal principles , slavery was unconstitutional and illegal. This site in the reprint series reprints a scholarly constitutional law text showing likewise in detail, by Lysander Spooner (1808-1887). Spooner lists every slavery-related legal and constitutional law issue being raised at the time, then provides a thorough explanation for each one. Some issues you may have heard of, others, likely not. The book is heavily footnoted, in the lengthy, multi-page-long footnote-style of that era, with references to then well-known constitutional and analytical experts and authors (Blackstone, Jacobs, Kent, Vattel, etc.) and precedents (reported by Cranch, Wheaton, etc., issued by Supreme Court Judges Jay, Marshall, Story, etc.).

I n truth, I have not been entirely candid in composing the above title. Spooner never said that much about foreign policy as such; but did have a lot to say about governments and wars, and that is close enough for present purposes. Another snag is that few have ever heard of Spooner, something which I now hasten to remedy.
FROM ENGLISH LAW TO NATURAL LAW TO RADICAL INDIVIDUALISM
S pooner’s lifetime saw many important changes in American life. Born in Massachusetts in 1808, he grew up in a largely free society whose constituent republics were united on the basis of consent. By the time he died in 1887, he had seen the central state strengthened by fire and sword, 1861-1865, and the union shifted to a basis of naked force. The whole time, however, it was maintained by those in authority that nothing substantial had really changed. As Joseph Sobran likes to say, this is apparently what it means to have "a living Constitution." Having early turned a critical eye on government, Spooner had become a critic of the Constitution even as that document underwent some of its major sea-changes.

Lysander Spooner was born on January 19, 1808 in Athol, Massachusetts and died in Boston in his eightieth year on May 18, 1887. The early part of his life was spent on his father's farm in Massachusetts, and until the age of twenty-five Spooner was apprenticed to his father. He left his father's farm at the age of twenty-five to become a clerk at the registry of deeds in Worcester, Massachusetts, but shortly thereafter began to study law at the office of John Davis and later Charles A. Allen. Spooner spent his first seven years as a lawyer in Ohio where he became involved in the Freethought movement and wrote “The Diest's Reply to the Alleged Supernatural Evidences of Christianity.” The tone of this early pamphlet “gave an indication of his later disdain for constituted authority” (Martin, 1953, p. 168).
Spooner became involved in a conflict with the federal government between 1841 to 1845 when private mail companies were “making profits from carrying letters for 5 and 10 cents each, while providing service somewhat more expeditious than that furnished by the federal postal system” (Martin, 1953, p. 170). Spooner established his American Letter Mail Company in 1844 which carried letters between Boston and New York, and later expanded to include Philadelphia and Baltimore. The reaction of the federal government to the private mail companies was nothing short of tyranny: they were to be put out of business by legislation.

Por Gorka Etxebarría Lysander Spooner (1808-1887) es uno de esos autores que, pese a su brillantez, son desconocidos en Europa y que, en Estados Unidos, aún no tiene el tratamiento que merece (salvo por algunos autores como Rothbard, David Friedman y Randy Barnett). Spooner fue un héroe de la libertad: luchó por la abolición de la esclavitud, se enfrentó a quienes querían equiparar los vicios con los crímenes ilegalizando el alcohol y apostó por el individuo al defender el derecho natural frente a los continuos atentados a los derechos fundamentales perpretados por gobiernos que alegan el interés social para “imponer la dominación” (palabras de Spooner en A letter to Thomas Bayard de 1843).
Quizá después de que Spooner fundara una compañía de correos privada y ofreciera sus servicios al gobierno obteniendo una respuesta curiosa; la expropiación de la misma, se planteó el anarco-individualismo. Sin embargo, da igual el motivo que le empujó a defender una sociedad sin estado porque sus argumentos bien merecen nuestra atención.
Para Spooner la constitución, si era un contrato, carecía de validez porque sólo lo habían firmado unos pocos y no las generaciones posteriores a la ratificación de la carta magna.

Lysander Spooner

Theorist, pamphleteer, activist, and businessman, Lysander Spooner joined ideas with action making him one of the most interesting figures of the classical liberal tradition. Spooner, a constitutional lawyer, activist in the abolitionist movement, and founder of his own private postal service, is best known for his No Treason pamphlets which pursued liberal theories of consent and natural rights to what Spooner thought were their natural conclusions: that no one was bound by any agreement he had not personally agreed to. Born in 1808 the son of a New England farmer, he left home at the age of 25 to enter law. The rule of Massachusetts courts required a student to study in a lawyer's office before admission to the bar - three years was required of a college graduate; but for a non-graduate, five years were required. Believing this rule discriminated against the "well-educated poor," Spooner set out to test the constitutionality of the provision, offering his services as a lawyer without the required training. Spooner's petition, "To the Members of the Legislature of Massachusetts," certainly was not the only force to bring about the change, but it did crystalize the prevailing sentiment. In 1836 the Massachusetts legislature abolished the rule.

    Lysander Spooner was a late nineteenth century anarchist. The American anarchist movement provided a crucial step in the development of libertarian philosophy, coming between the American abolitionists and the Austrian School economists. Spooner's classic work, No Treason , attacks the moral authority of government, supporting instead a system of voluntary agreements. Spooner was a Massachusetts lawyer active in the abolitionist and anarchist movements. In challenge to the newly established U.S. postal monopoly, he set up his own post office, the American Letter Mail Company. While he was forced out of business by government prosecution, his model of competition forced the Post Office to lower its stamp rates for the first and only time in its history.     Murray Rothbard and others on the "libertarian" right have argued that Lysander Spooner is another individualist anarchist whose ideas support "anarcho"-capitalism's claim to be part of the anarchist tradition. As will be shown below, however, this claim is untrue, since it is clear that Spooner was a left libertarian who was firmly opposed to capitalism. That Spooner was against capitalism can be seen in his opposition to wage labour, which he wished to eliminate by turning capital over to those who work it. Like Benjamin Tucker, he wanted to create a society of associated producers self-employed farmers, artisans and co-operating workers rather than wage-slaves and capitalists. For example, in his Letter to Cleveland Spooner writes: "All the great establishments, of every kind, now in the hands of a few proprietors, but employing a great number of wage labourers, would be broken up; for few or no persons, who could hire capital and do business for themselves would consent to labour for wages for another."     -There are no known extant copies. It is described in Liberty as "A four-page tract. Price, 5 cents" in a list that is said to be "in an order corresponding closely to that of the order of publication" which puts it between 1834 and 1844. While there is no doubt that this is an early Spooner work(corresponding with his early interest in religious matters which seemed to wane in later life) the exact year of publication is unknown, it's position on this list is an educated guess.     One of the Old Guard of Abolition Heroes, Dies in His Eightieth Year After a Fortnight's Illness. Boston Daily Globe, May 18, 1887. John Boyle O'Reilly Predicts a Monument to His Memory In all the years that he was engaged in such active warfare he found time for vigorous controversy upon all questions of interest, religious, political or social. In 1835 he published a pamphlet entitled, "A Deist's Reply to the Alleged Supernatural Evidences of Christianity," and another entitled, "The Deist's Immortality and an Essay on Man's Accountability for His Belief," both of which are very vigorously written and indicate striking independence of mind, but which in the light of modern science and later researches are seen to be of little value. Though a disbeliever in all the accepted systems of religion, including Christianity, MR. Spooner was not an atheist or a materialist. He firmly believed in the existence of a deity, and had little doubt of a future life. Apropos of his religious views, the following anecdote may be interesting. At the time when the Millerite craze was at its height, and the end of the world was expected momentarily, some of the believers abandoned all work and neglected their crops, in view of the approaching catastrophe. At Athol several of these were arrested on a charge of vagrancy, the complain being made by the more orthodox sects. The prosecution secured lawyers from adjoining towns and prepared to crush the victims, who were non-resistant, would employ no counsel, and had to be carried bodily into court. Mr. Spooner was present, and at the critical moment pointed out a flaw in the indictments which set the prisoners free. The orthodox were highly indignant at this result, and on of the ministers said to Mr. Spooner:
