by Brett Glass The EFF's "Open Audio License" is claimed to provide "freedom and openness," but may deprive writers, composers and performers of rewards for their work and expose them to damaging exploitation Introduction The Electronic Frontier Foundation , a non-profit organization whose purpose is to promote and protect civil rights in cyberspace, has recently published a document titled the " Open Audio License If you, as an artist, license your work under the OAL:
  • You cannot allow free copying of a recording but keep the rights to the song that was performed in the recording. You cannot restrict copying and distribution of your work to noncommercial reproduction by fans ("tape trading") only. You may have no recourse if your music is used in ways that hurt your reputation as an artist or as an individual. If you are a performer rather than a composer, you have no right to receive credit for, or profit from, your rendition of an "OALed" work. If you make improvements to an OALed work but are not the original author, you are entitled to neither credit nor financial rewards for your efforts.

    San Francisco - The Electronic Frontier Foundation (EFF) today expressed concern over a California court conviction of H. Keith Henson in a case involving online criticism of the Church of Scientology (CoS). In a decision which appears to have violated his constitutional right to free speech, a jury in Riverside County convicted Henson of threatening the free exercise of religion by members of the CoS. "We are deeply concerned that the decision violates Mr. Henson's free speech rights," said EFF Legal Director Cindy Cohn. "Since he does not appear to have made any credible threat of physical attack as required for conviction under the U.S. Constitution, Mr. Henson has a legal right to express criticisms online without fearing a prison term." On April 26, 2001, Henson was convicted of threatening to interfere with the CoS members' freedom to enjoy their constitutional right to the free exercise of religion. Although official trial documents are not yet available, the verdict seems based on Henson's activities while picketing the CoS desert compound and postings on the Internet alt.religion.scientology newsgroup. It appears that the postings admitted into evidence included only fragments of longer postings or threads taken out of context. For example, the defense was apparently prohibited from showing that a comment about "cruise missiles" was made in response to a joke about actor Tom Cruise. The trial judge also allegedly forbid Henson from explaining why he was protesting Scientology.

Die Gründung der Electronic Frontier Foundation ( EFF ) ist eng verknüpft mit den Diskussionen, die in der Onlinecommunity WELL geführt wurden, weil gegen Craig Neidorf ('Knight Lightning') wegen seiner Publikationen für das EZine 'Phrack' Anklage erhoben wurde. EFF setzte damals vor Gericht durch, daß für Onlinepublikationen (in den U.S.A.) die gleichen strengen Zensurverbote zu gelten haben, wie sie für gedruckte Medien gelten. John Perry Barlow
is a retired Wyoming cattle rancher, a former lyricist for the Grateful Dead , and co-founder of the Electronic Frontier Foundation . Since May of 1998, he has been a Fellow at Harvard Law School's Berkman Center for Internet and Society , following a term as a Fellow with the Institute of Politics at Harvard's John F. Kennedy School of Government He was born in Sublette County, Wyoming in 1947, was educated there in a one room schoolhouse, and graduated from Wesleyan University in Middletown, Connecticut with an honors degree in comparative religion in 1969. In 1971, he began operating the Bar Cross Land and Livestock Company , a large cow-calf operation in Cora, Wyoming where he grew up. He continued to do so until he sold it in 1988. He co-wrote songs with the Grateful Dead from 1971 until their demise in 1995. He's known them since they looked like this In 1990 he and Mitchell Kapor founded the Electronic Frontier Foundation, an organization which promotes freedom of expression in digital media. He currently serves as its Vice Chairman.
