Mitigation..and then Litigation?
One of the realities of the year 2000 issue is that there is a great potential for lawsuits. In our increasingly litigious society the often-quoted prediction of a decade of litigation after January 1, 2000 seems believable. This possibility has not been lost on companies; and there has, therefore, been a reduced amount of information companies have been willing to make available on product readiness. Maybe things will change.
The New Law
In October, President Clinton signed a new law called the "Year 2000 Information Readiness and Disclosure Act." One of the intentions of the new law is to promote disclosure and exchange of information regarding year 2000 issues. To accomplish this, the idea is to raise the bar (no pun intended) for the use of year 2000 statements as evidence in a law suit, so long as certain legal tests are met. There are various exclusions and provisions of the law, and only a couple of them are covered below. You mean you haven't given it much thought until now? Well, don't panic. This discussion will not address the legal issues that arise from the Y2K computer problem, nor will it address long-term strategic planning. Those sessions took place in 1998 and earlier this year. Instead, we'll discuss the last-minute issues you should consider in making your office Y2K-ready. Your Hardware It is important to understand that even if all your software is brand new, it still gets date information from the hardware. Check the BIOS chip.

    When it comes to checking for Y2K compliance, now is better than the next century

    Daryl Teshima is the editor-in-chief of Legal Assistant Today and Law Office Computing, two bimonthly magazines published by James Publishing. He can be reached on the Internet at dteshima @netcom.com Some predict that the year 2000 (Y2K) problem will bring disaster. Others label it as a bogeyman in the service of technology consultants. To many lawyers, Y2K appears distant, remote, and trivial compared to the daily demands of judges, opposing counsel, and clients. Besides, most law firms do not employ mainframes-the computers most susceptible to the problem-but instead primarily use recently purchased personal computers and software. What if, however, a fraction of the predicted Y2K problems occur? Then attorneys could have a major and long-lasting office hangover after January 1, 2000. Besides computers and programs, Y2K can affect such office systems as telephones, voice mail, automated security, elevators, and anything else that relies on a microchip. For this reason, the estimated cost of dealing with Y2K in Europe and the United States is now $858 billion. Ignoring Y2K could have catastrophic consequences for a lawyer's practice. Y2K is one deadline that even judges cannot extend. A lawyer can, however, start debugging today. The Date Set Test A dramatic Y2K problem will occur if a computer's clock and operating hardware cannot recognize the correct date after December 31, 1999. Most applications rely on the computer's internal clock for the date and time. For example, if the operating hardware gives erroneous or unreadable date and time information to a calendar and datebook program, it will not work properly. Although most computers sold within the past three years do not have this problem, the average older PC-especially one still running DOS-may.

    The Near Term Future of Law Enforcement

    As we ease into a new century it is a good time to look at some trends in our society that are impacting law enforcement organizations and operations. As you know in a fast changing society, predicting the direction of trends is about as difficult as predicting the weather. However, if we limit our observations to the next few years, there is reasonable possibility of being accurateprovided that nothing unusual, unpredictable, or disastrous happens. The best prediction I can make with assurance is that several unforeseen events will occur which will alter the course of current trends.
    The purpose of this article, however, is not so that you can plan department strategies. Rather, its aim is to help us recognize the law enforcement issues that we need to discuss, observe, and more accurately identify. It is through the process of observation and discussion that we will more clearly define pertinent issues. At that time, we can then begin to devote appropriate resources to either blunt a negative trend or take advantage of a positive one to strengthen our operations and streamline our organizations.
    Overview
    Our increased professionalism in the past century is further evidenced by the significant elevation of employment standards; establishment of quality recruit training programs throughout North America; and the employment of a significant number of minorities. We have embraced new management techniques, modernized department management and operations through the use of high technology, and developed incredible new investigative techniques. We have reduced the number of the incidents that invite excessive force complaints and made strides in developing ways to control violent people without the use of deadly force. These are but a few examples of how our law enforcement agencies differ from those of a century or half century ago. By any professional standard, the record is indicative of how we have made significant progress.

MALACANANG PALACE Manila BY THE PRESIDENT OF THE PHILIPPINES EXECUTIVE ORDER NO. 14 ESTABLISHING THE PRESIDENTIAL COMMISSION ON YEAR 2000 COMPLIANCE WHEREAS, consistent with State policies as enunciated under Section 24, Article II of the Constitution, which states that "The State recognizes the vital role of communication and information in nation-building"; WHEREAS, the Constitution also provides, in Section 10, Article XIV, that "Science and technology are essential for national development and progress. The State shall give priority to research and development, invention, innovation and their utilization; and to science and technology education, training and services.     Interdisciplinary Practice Groups Prompt A Trend Toward Strategic Business Units The National Law Journal , May 17, 1999 By Martin Gold and Donna J. Childress The Year-2000 problem will have an unexpected impact on law firms: not a mysterious crash of the document management system or an upset in billing, but a positive effect that will help law firms align themselves to bring in new business in 2000 and beyond. Until recently, most firms have sold their services along practice area lines, with health care groups serving health care clients and real estate groups handling real estate issues. But because the Y2K problem is multidisciplinary and complex, firms are finding the old formula isn't adequate to meet their clients' new needs. As a result of clients' sudden demand for assistance with Y2K issues, firms began to form Y2K teams that combined many different practice areas. Now lawyers with specialties as diverse as Employee Retirement Income Security Act and intellectual property suddenly find themselves united for a common cause: a shared client. The business term for these cross-practice-area teams is strategic business unit (SBU). Traditional practice groups are formed to serve clients with a problem that is contained within one area of the law, such as securities or real estate, but SBUs are structured to serve clients with complex problems that span many practice areas.

    Protecting Large Law Firms from Y2K: The Obvious and Not-So-Obvious
    Thirty-two of the nation's top fifty law firms have formal Y2K practice committees. As well many mid-size and solo practitioners have hung their Y2K shingle. Dozens of legal manuals, hundreds of articles, thousands of conference attendees and countle ss glossy brochures later, firms are still touting their credentials as the experts to deal with a unique and unprecedented issue. The primary reason for all this attention and financial commitment to Y2K is the promise (or fear) of a deluge of litigation that is expected to arrive on January 1, 2000, or shortly thereafter. David L. Schaefer, CPCU, Armfield, Harrison & Thomas, Inc. coined the term "technology asbestos" to describe Y2K litigation. Others believe this is an understatement. All of this activity demonstrates a trait not commonly associated with large law firms: business foresight. However, most firms have viewed Y2K too narrowly and have focused far less attention on the affects of Y2K on themselves. In the brief framework of this Second Opinion piece, I have the challenging task of explaining these obvious and not so obvious impacts on law firms, with an emphasis on large, more technology dependent law firms. In short, Y2K will take its T.O.L.L. on many firms. The four categories of exposure facing law firms are Technology, Operations, Liquidity and Liability.

    What's it about? Recently the author received a letter from his friendly local Council Officer. To make a long story short, I was informed that the roots of a tree in our front yard had allegedly dislodged a section of footpath. And just to make the point in demanding payment to cover the expense, the Council claimed that any injury suffered by a pedestrian as a result of the broken footpath would be the fault of the property owner (myself) and could land my family in court with a hefty personal injuries claim to settle. I was not amused, as you can imagine (not the least because the letter was dated 31/12/99 and the Council offices had already closed for a number of days). I immediately wrote back with a little legal analysis of my own. Yes, I agreed, it may in fact be dangerous, but since I was quite prepared to pay for the rectification of the problem, and authorised such in my reply, the ball was most definitely in their court. As I had no legal recourse to barricade the offending public area, I suggested that they do so or fix the problem forthwith (a month later I have not even had the courtesy of a reply, let alone any remedial activity in front of my house). The fact that nothing has been done might suggest that the threats of looming legal actions were the stick with which to obtain my payment for the work.

Exactly 1,000 years ago, end-of-the-world fever was sweeping Europe as the year 1000 approached. There were plenty of signs - Halley's comet had made a particularly scary appearance in 989. Four years later, many European cities were ravaged by fires. In 999, Sylvester II became the first French Pope. People generally believed that the devil would come down, wreak some havoc, and then be driven away. Priests prepared parishioners for the arrival of the antichrist. Then the big day came. And went. After the shock of still existing in a world with a 4-digit date abated, humanity got back to its main business of creating food, shelter, wars, and excuses. There was another flurry of apocalyptic expectation in the year 1033, which was 1000 years after the crucifiction. Then people just went back to the business of living.* For instance, I performed an experiment on the 486 in my home office. I went into DOS and tried to reset the date to January 1, 2000. "INVALID DATE" was the reply. It would take the date of December 31, 1999. I then set the time to 11:59, and as I ticked off the seconds to the new year I wondered what would happen. It just moved back in time - the year 2000 is a barrier that my DOS machine cannot cross. When I looked a few days later, I saw that the computer had moved further back in time to the beginning of 1980. This pretty much describes the situation for any computer still running Windows 3.1 or DOS. Windows 95 and Macintoshes should be fine, although this test should be run on all the PCs in your area to be sure.
