Disability Discrimination Act 1995 : Part 4
Governing bodies now have new legal duties under Part 4 of the Disability Discrimination Act 1995 (DDA). From September 2002 it has been unlawful for schools and the LEA to discriminate against disabled pupils (and prospective pupils) in the provision of education and associated services in schools, and in admissions and exclusions. The governing body is ultimately responsible for the school's duty not to discriminate. The Disability Rights Commission (DRC) has issued a Code of Practice for Schools (Disability Discrimination Act 1995 : Part 4) which is now in all schools. The DDA requires schools and LEAs:
    · to take "reasonable steps" to ensure that disabled pupils, or prospective pupils, are not placed at a substantial disadvantage compared to their non-disabled peers;
The Act does not require schools to remove or alter physical features of the school as a matter of course in order to comply with the Act, but to make reasonable adjustments in order to ensure that pupils with disabilities are not disadvantaged. The need to carry out changes to the physical features of the school is covered by the planning duties whereby LEAs and schools should plan to make the necessary changes. Schools also have a duty under Part 3 of the Act to overcome (i.e. remove, avoid, alter) barriers to access to the school for parents and other members of the public attending school or community activities from 2004.

These studies also strongly suggest that the dropout rate among students receiving special education services significantly exceeds the dropout rate among the general school-age population. The St. Paul Public Schools conducted a retrospective examination of the records of 4,500 students in attendance between 1974 and 1977 who left school prior to graduation. They found that up to 80% of the youths who dropped out may have been eligible for special education services. Hippolitus (1980) cited the Bureau of Education for the Handicapped as documenting the dropout rate for special education students at five to six times the rate of youths without handicaps. IMPLICATIONS AND RECOMMENDATIONS The implications of these findings have special significance for educational policy and practice. More systematic procedures for identifying potential dropouts and better follow-through in providing comprehensive programs that retain students with handicaps must be addressed.

Myth vs. Fact
Promoters of "educational choice" make many assertions about the positive effects of private school vouchers on America's educational system. Are these claims true? What would vouchers really do? Let's examine some of the common myths about vouchers and review the facts. MYTH: Vouchers are a constitutional way to assist parochial and other private schools. FACT: Vouchers result in tax dollars flowing to private sectarian schools. Sectarian schools account for 85 percent of the total private school enrollment in the United States. These schools serve as arms of religious ministries and integrate religious values and doctrine throughout their curriculum, indoctrinating students on controversial subjects such as abortion, creationism and the role of women in society. Church-state provisions in the federal and state constitutions prohibit government from subsidizing sectarian education, either directly or indirectly. As a result, federal and state courts have repeatedly struck down various schemes designed to funnel tax dollars to religious schools. The fact that parents may "choose" the private school is legally irrelevant, because public funds will still be used for religious instruction. Voucher plans have been struck down in Florida, Maine, New Hampshire, Ohio, Pennsylvania, Puerto Rico and Vermont, even when some laws provided funds for public school choice.

Specifically I am referencing your co-sponsorship of the Education Excellence Act of 1999 and other commitments to expand appropriations for special education. As you may know I am an advocate for blind people being an officer of the National Federation of the Blind of New Hampshire. I also serve on several committees and have been an active advocate for all persons with disabilities. Most importantly I am a disabled father of a disabled student. I have in "an up close and personal" way observed how the lack of full funding of special education has pitted neighbor against neighbor; school against parent; and ultimately a system against our very treasured offspring. Our disabled children. Our future. As resources are fought over many of our disabled children go without assistive technology, specialized instruction (like braille literacy), and a myriad of other necessities that would ultimately make each of our special needs children fully educated and independent adults. Often schools avoid meeting their obligations to identify, evaluate or "code" our children with disabilities because they fear the financial ramifications associated with meeting these obligations. Just as often costly litigation is the result. Our special needs children are caught in the crossfire.
