T he National Housing Law Project (NHLP) is a national housing law and advocacy center. The goal of NHLP is to advance housing justice for the poor by increasing and preserving the supply of decent affordable housing, by improving existing housing conditions, including physical conditions and management practices, by expanding and enforcing low-income tenants' and homeowners' rights, and by increasing opportunities for racial and ethnic minorities. NHLP works to achieve that goal by providing legal assistance, advocacy advice and housing expertise to legal services and other attorneys, low-income housing advocacy groups, and others who serve the poor. Memorandum Of Understanding Among The Department Of The Treasury, The Department Of Housing And Urban Development, And The Department Of Justice Preamble The United States Departments of the Treasury, Housing and Urban Development, and Justice enter into this memorandum of understanding (MOU) in a cooperative effort to promote enhanced compliance with the Fair Housing Act (ACT) , 42 U.S.C. §§ 3601 et seq., for the benefit of residents of low-income housing tax credit properties and the general public. It is recognized that the Department of Treasury's (Treasury) Internal Revenue Service (IRS) is responsible for administering and enforcing the tax laws in the low-income housing tax credit program under § 42 of the Internal Revenue Code, 26 U.S.C. § 42. In accordance with § 1.42-9 of the Income Tax Regulations, 26 C.F.R. § 1.342-9, low income housing tax credit properties are to be rented in a manner consistent with the Act. Noncompliance of these properties with the low-income housing tax credit provisions is required to be reported to the IRS by state housing finance agencies under 26 U.S.C. § 42(m)(1)(B)(iii).

FY 2000 Budget Resolution Signals Trouble for Low-Income Housing Programs
Congress has adopted a $1.74 trillion FY 2000 budget resolution which sets the parameters for spending by the appropriations committees. The measure, which does not require presidential approval, is a blueprint for allocations that will be made for spending within each of the 13 appropriations subcommittees, including the HUD subcommittee. Among the principal features of the congressionally approved budget are a multi-year $778 billion tax reduction, increased spending for education and defense, and deficit reduction through application of the Social Security surpluses to the national debt. According to projections contained in a letter prepared by the Campaign for Housing and Community Development Funding, the budget assumes huge cuts in discretionary outlays for the federal low-income housing programs. The Income Security budget function, which includes most of the low-income housing programs including public housing, vouchers and housing for the elderly and disabled, would face reductions of 14 percent, or $34 billion, over five years and 21 percent, or $110 billion, over 10 years.

Section 8 Housing - The Section 8 rental voucher and rental certificate programs are the federal government's major programs for assisting very low-income families, the elderly, and the disabled to rent decent, safe and sanitary housing in the private market . Since the rental assistance is provided on behalf of the family or individual, participants are able to find and lease privately owned housing , including single-family homes, townhouses and apartments. The participant is free to choose any housing that meets the requirements of the program and is not limited to units located in subsidized housing projects. Eligibility for a Section 8 rental voucher or certificate is determined by the HUD Housing Authority based on:

What Kentucky's Fair Housing Law Means

Kentucky's Fair Housing Law forbids discrimination in housing because of a person's color, religion, race, sex, national origin, familial status or disability. It is unlawful for a real estate operator, broker, or sales agent to:
  • refuse to sell, rent, lease or exchange real property for discriminatory reasons
  • refuse to receive or transmit good faith offers to purchase or rent.
  • deny any services or facilities relating to real property transactions
  • represent that real property is not available for inspection, sale or rental when in fact it is
  • retain a listing with the understanding that the seller plans to discriminate
  • discriminate in the terms or conditions of sale or rental
It is unlawful to coerce, intimidate, threaten, or interfere with any person in the exercise or enjoyment of any housing rights. It is unlawful for a financial institution to:
  • discriminate in the granting, rates, terms, conditions or services of financial assistance in real estate transactions
  • discriminate in making or purchasing of loans
It is unlawful for a real estate operator or a financial institution to:
  • engage in the tactics and practices of panic-selling; to represent that the racial composition of a neighborhood is going to change or that property values will lower; or make similar false and misleading statements

Taking Action to End Poverty... The National Center on Poverty Law (NCPL) is a legal and policy research, communications, and advocacy organization that provides national leadership in identifying, developing, and supporting creative and collaborative approaches to achieve social and economic justice for low-income people. Established in 1967 by R. Sargent Shriver as part of the War on Poverty, NCPL is now a nonprofit organization that facilitates creative and collaborative approaches for representing low-income people in social policy and poverty law. The organization's legal program translates our mission into action, drawing its agenda by working collaboratively with clients, advocates, social service providers, policymakers, and others on systemic solutions to problems that affect large numbers of people.       The U.S. Department of Housing and Urban Development (HUD) is the Federal agency responsible for national policy and programs that address America's housing needs, that improve and develop the nation's communities, and enforce fair housing laws. Click here to download as an Acrobat file the 2002 Housing Resource Directory produced by the Tennessee Division of Mental Retardation Services. Click here for HUD's information for people with disabilities. Several programs funded by HUD and administered by state and local housing agencies include:
      • Public Housing is low-income housing, operated by your local housing authority.
      • Section 8 Housing is subsidized housing, in which the housing authority gives the tenant a certificate or voucher that says the government will subsidize your rent payments and then you find your own housing.
      • Privately Owned Subsidized Housing , where the government provides subsidies to the owner who then applies those subsidies to the rents he/she charges low-income tenants.
      • FHA Mortgage Insurance Program is a mortgage financing program through the Federal Housing Authority (FHA), a division of HUD. FHA guarantees home loans of 1 to 4 units against default by the borrower. The mortgage industry process approves or rejects loan applicants, then forwards to FHA for default insurance purposes. The borrower pays a mortgage insurance premium (MIP) for this protection. The mortgage limit for the Nashville area is $193,800.

    The County of Santa Barbara HOME Consortium, with the assistance of its member cities of Santa Maria, Lompoc, Guadalupe and Carpinteria, prepared an Analysis of Impediments to Fair Housing Choice in May 1997, which was updated in March 2000. As part of the preparation, a survey of community service agencies was conducted to assess the number and types of Fair Housing complaints, Home Mortgage Disclosure Act data were collected and analyzed, and maps of the County's racial composition were created. As a result, impediments were identified and an action plan was developed. The following four impediments were identified through the Analysis for the City of Santa Maria.
  • A primary impediment to equal choice of housing in the City at present is the lack of availability of affordable housing, particularly units for large families. Based on the vacancy rates, there is clearly a greater need for larger rental units than for zero and one bedroom units. The lack of affordable larger units constitutes an impediment to Fair Housing, and because Hispanic households tend to be large, they are disproportionately affected.
  • Concentrations of low income and racial/ethnic populations are often segregated from other Santa Maria residents.
