The HEM staff has been considering pulling these listings. The main reason is that as homeschooling becomes more widely accepted, and as states are scrambling to reform their education system, the situation becomes more complex. This makes overviews, listings and rankings less valid. We have, however, decided to keep these listings in place because they carry, at a minimum, a link to your state government. Additionally we hope reading cited code and at least one homeschooler's interpretation will help start to demystify legislation and encourage you to investigate further. When talking to new homeschoolers we often hear concerns about the law. Is homeschooling legal? Who do I have to notify? What do I have to teach? While the legalities are a concern that should not be ignored, neither should our response be automatic and not thought out carefully.
There is no single source, no one true homeschooling authority. We all own the responsibility to think through laws and regulations on homeschooling. Of course you'll find those who disagree - an entire industry has grown up around the fact that there are differences of opinion on homeschooling's legal matters. What we offer here are overviews of laws and regulations compiled by knowledgeable homeschoolers. These files are not legal advice nor the final word on the subject. They are simply a starting point. To maintain our freedom to homeschool we will each need to go far beyond any convenient compilation or synopsis. We need to continue to do our own learning, lead our own research, and decide on our own actions.

The Ozone Action Program
In the Spring of 1997, the Clean Air Coalition, of which the DEQ is an active partner, initiated an Ozone Action Program for the Baton Rouge ozone nonattainment area. The Ozone Action Program is a voluntary public education program designed to reduce ozone-forming emissions during the summer months in the Baton Rouge area. The program consists of two basic elements: a commuter services plan; and an "Ozone Action Day" plan. The commuter services plan provides information and incentives to businesses and agencies to sponsor a commuting alternatives plan for employees. The "Ozone Action Day" plan encourages voluntary measures to reduce ozone-forming emissions on summer days when high levels of ozone are predicted. The DEQ and the Capital Regional Planning Commission (CRPC) cooperated in the implementation of this program, which includes the development of press packets, web pages, and an employer/employee notification plan for participants in the program.

LEGISLATURE - LOUISIANA Regular Session, 1999
HOUSE BILL NO. 1955
BY REPRESENTATIVES HUNTER AND MARIONNEAUX AN ACT To enact R.S. 17:164.2, relative to school buses used to transport students; to require that certain buses be equipped with occupant restraint systems;
to provide relative to rules and regulations of the State Board of Elementary and Secondary Education; to provide relative to compliance and funding; and to provide for related matters. Be it enacted by the Legislature of Louisiana:
Section 1. R.S. 17:164.2 is hereby enacted to read as follows: §164.2. Additional regulations; occupant restraint systems required; compliance A. In addition to any regulations adopted by the State Board of Elementary and Secondary Education pursuant to the provisions of R.S. 17:164 relative to the construction, design, equipment, and operation of school buses used in the transportation of students, the board also shall adopt rules and regulations in accordance with the Administrative Procedure Act and any applicable federal standards to require that every bus used primarily for the transportation of students shall be equipped with occupant restraint systems by not later than June 30, 2004.

Registration/Licensing/Accreditation: Recordkeeping/Reports: The Superintendent of Education annually reimburses approved nonpublic schools for the actual cost incurred for providing school services, maintaining records and completing and filing mandatory reports e.g. Helms v. Cody , No. 85-5533, 1994 U.S. Dist. Lexis 8206 (E.D. La. June 10, 1994). Length of School Year/Day: Discrimination: Private schools that are racially segregated are ineligible for state assistance of any kind, including textbooks, materials and transportation. Brumfield v. Dodd , 405 F. Supp. 338 (E.D. La. 1977). Teacher Certification: Curriculum: Special Education: Helms v. Cody , No. 85-5533, 1994 U.S. Dist. Lexis 8206 (E.D. La. June 10, 1994). Health: Safety: Transportation: The Secretary of the Department of Revenue and Taxation will make refunds of gasoline taxes on gasoline used for operating any boat to transport children to or from parochial schools. Home Schooling: A home study plan is a program in which an approved curriculum can be implemented under the direction and control of a parent or a tutor. Any child eligible to attend an elementary or secondary school in Louisiana is eligible to participate in a home study plan. Home study regulations are found at R.S. 17:236 and 17:236.1. An initial application must be made within 15 days of beginning a program of home instruction. A renewal application must be made by the first of October of the school year or within 12 months of the approval of the initial application, whichever is later. A renewal application is accepted upon presentation of satisfactory evidence that the program offered a sustained curriculum of a quality at least equal to that of the public schools at the same grade level. The sustained curriculum can be substantiated in several ways, including presentation of test results on which the student scored at or above his/her grade level or description and substantiating documents detailing the contents of the instructional program.
