(Computerworld, 20 July 1998) The last TechLaw column focused on the insurance aspects of the "Y2K bug"with the action by Wilson White on its complaint to the Commerce Commission on vendors requiring payment for "Y2K bug" fixes. This article explores steps that can be taken to prevent Y2K problems and put purchasers in a stronger legal position if their technology fails the date change leap from 31 st December 1999 to the 1 st of January 2000. Many IT managers divide their review of technology for Y2K issue into two parts. The first part of the review is to identify the technology staying in place after the 1 st of January 2000. The issue here is how to make that technology Y2K capable and who bears the costs. The second part of the review is to ensure that the replacement technology is Y2K compliant. The issue here is often seen as being simply ensuring compliance. The first aspect reviewed is now generally well understood. It is the second aspect that illustrates the extent of the problem faced by many IT managers. According to a recent

The Madrid Protocol Approved by the U.S.

Late last year, President Bush signed a law implementing the accession of the U.S. to the recently ratified Protocol Relating to the Madrid Agreement Concerning the International Registration of Marks (Madrid Protocol). This trademark treaty, adopted in Madrid, Spain, on June 27, 1989, provides for participation in the international registration system for trademarks. See See Fed. Reg. Vol. 68, No. 60. These rules set forth the requirements for submitting international applications and will be designated in Part 7 of 37 C.F.R. as the rules of practice in filings pursuant to the Madrid Protocol. A hearing is scheduled for May 30, 2003 to consider comments. We expect that rules substantially in the form of those proposed will be implemented. Later this year, the USPTO is also expected tocreate the instrument of accession for deposit by the U.S. with the International Bureau of the World Intellectual Property Organisation (WIPO) – the entity that maintains the International Register of Marks.

We cannot teach language without content. Finding appropriate content, however, is a constant challenge. How many topics are there that would be of interest to every student in our classes? I believe that I have discovered a topic that promises to be of interest to all students (regardless of age, gender, nationality, cultural background): Y2K. The final countdown has begun. What will happen when the first day of the year 2000 arrives? Will the world as we know it come to an end? Or will there only be temporary minor disruptions to our daily routine? A wealth of information related to Y2K is available on the Web. There is a goldmine for lesson development. Where to begin the search? I decided to start with the first URL on a list of "Useful Websites" given to me by my colleague from George Washington University's School of Business, Dr. Stuart Umpleby, who has become an expert on the Y2K problem and is in great demand on the lecture circuit.

The development of the computer industry poses several technological, business and legal challenges. Over the course of years a magnitude of problems has surfaced. Several countries have entered legislation considering laws relating to liabilities involving manufacturers, consumers and technology consultants in the computer industry on-line. The computer and its related microprocessing and electronic system has a substantial role to play in development as an information super highway and as an invaluable database. With the development of the cybercafe and the Internet the world has become a smaller place where communication is easier and trade simplified. Hence the recent development of terms such as E-Commerce, E-Business, E-Trade, E-Cash signifying the electronic mode of doing commerce, business, trade, cash transaction respectively. The Internet can be defined as an international network of networks providing an open system for e-mail, newsgroups, mailing lists, home pages etc. With a world wide web thousands of servers or host computers use a standard programming language (HTML hypertext markup language) communicating through a standard protocol, HTTP - hypertext transfer protocol. Companies, schools, governments etc. establish sites of home pages at a given address (domain name) where users can access information from the home age there are hot links or hypertext links to other websites, using a web browser program, one and get access to information from the owners of a particular home page.

by Janis Reinken, Attorney / Director of Risk Management, TLIE Recently, TLIE was asked to participate in a series of Y2K seminars sponsored in Houston, Dallas and Austin by the State Bar of Texas, entitled "The Year 2000 Problem: Computing the Legal Risks for Attorneys and their Clients." I served as a panelist on two of those occasions, where lively discussion occurred regarding ethics and malpractice issues as a component of the larger Y2K picture. In addition to discussion of some of the office practice management matters, the hot topic emerged as the evolving and amorphous standard of care to which lawyers might be held. Perhaps one of the most fitting (and laugh-provoking) suggestions came from someone in the audience. Figuring the cost is about the same, just buy new systems and forget about paying for compliance analysis and remedial work on existing systems. In previous issues of the Advisory , TLIE has offered suggestions on office management and evaluation, and precautions in providing legal services for clients dealing with Y2K matters. In this issue, we turn our focus to the standard of care, given the difficulties lawyers face in anticipating what a reasonably prudent lawyer could or would do under the same or similar circumstances. At this point, the standard of care cannot be derived from case law because it is limited and evolving, and the full array of legal problems that might arise out of Y2K is not known.

Y2K Act On July 20, 1999 the Y2K Act (the "Act") was signed into law, the result of a federal effort to lessen the impact of Y2K litigation on businesses and individuals. The main features of the Act are:
  • Companies are given 90 days from the time they are notified to fix a Y2K problem before they can be sued. All companies responsible for a Y2K failure will share the legal liability, but each company cannot be forced to pay more than the portion of the damages which they specifically caused, or their "proportionate" share of the liability. Defendants are provided greater protection against Y2K lawsuits by limiting damages and encouraging the settlement of disputes through "alternative dispute mechanisms."
The Act applies broadly to all Y2K lawsuits brought after January 1, 1999 which claim that a Y2K failure is occurring, or could occur, before January 1, 2003. It important that businesses quickly become acquainted with the major provisions of the Act, because whenever a person or company now claims a Y2K failure or defect in their complaints, their lawsuits will be controlled by the Act. 90-Day No-Lawsuit Period Plaintiffs seeking damages must give each defendant written notice of the nature and cause of the plaintiff's harm 30 days before they file a lawsuit.

It also evaluates the legal treatment of fortuity theory by the courts. Finally, it analyzes problematic aspects of fortuity theory in both definition and application. The article concludes that so-called nonfortuity defense cannot negate insurance contract obligations. Jan. 1, 1999 The Information Technology Association of America will be conducting a special Webcast program consisting of two parts - audio and visual - on Wednesday, January 13, 1999 from 3:00-5:00 p.m. (EST) on the Year 2000 Information and Readiness Disclosure law. In order to participate in this program, participants must register in advance (by cob on Monday, January 11, 1999) and have Internet access. The cost to participate will only be the cost of a long distance phone call. A number of questions have come up regarding the law's applicability, protections, and the procedures a company should follow in order to make full use of its provisions. Leading legal/policy experts, who have helped draft the bill over the past year, will present an overview of the law and touch on some of the issues that have been raised by the SEC Y2K rules. ITAA will provide the presentation concurrently:

It was no accident that everything went smoothly. Working through the night, over 400 Customs personnel at our special command center, made certain there were no glitches. Our Information Technology (I.T.) staff, in particular, is to be congratulated for painstaking preparation and diligent follow through. Across the country, at ports of entry large and small, the men and women of the Customs Service stood watch. Your vigilance prevented suspected terrorists from entering the United States in recent weeks. Unknown additional threats may have been deterred as a result. The role of U.S. Customs in safeguarding America on this momentous date is now a matter of record. It is also a matter for history. The words of the medal citation for our Port Angeles inspectors is fitting for the entire Customs family today: You have brought great credit upon yourselves, the United States Customs Service, and the United States of America.
