General Information Sheet History: In 1973, the Ohio General Assembly created the Ohio Ethics Commission as part of the Ethics Law. The law, effective January 1, 1974, created new ethical standards for public officials and employees by: requiring personal financial disclosure; creating new restrictions upon unethical conduct with criminal sanctions; and, establishing uniform review of ethics issues by state-wide commissions of the three branches of government. Authority: The Ohio Ethics Commission administers the Ohio Ethics Law and related statutes for all public officials and employees at the state and local levels of government, except for state legislators and their employees, and judges and their employees. For legislators and their employees, the law is administered by the Joint Legislative Ethics Committee. For judges and their employees, the law is administered by the Board of Commissioners on Grievances and Discipline of the Ohio Supreme Court. Members: The Ethics Commission is a bipartisan commission comprised of six members who are appointed by the Governor and confirmed by the Ohio Senate. The Commission members, who serve staggered, six-year terms, are:

SEMA Branches Executive Branch Jerry B. Uhlmann , SEMA Director, manages all SEMA operations both during and after a disaster and on day-to-day business. SEMA is a coordinating agency between local, state and federal agencies. Col. Uhlmann retired from the Missouri National Guard where he was head of Military Support to Civil Authorities. SEMA is located in the Department of Public Safety, Office of the Adjutant General. During a disaster, SEMA reports directly to the Governor's Office. Beaufort C. "Buck" Katt , Deputy Director. He assists the Director by the day-to-day supervision of the various branches and programs within the Agency. In addition to 15 years of service with the State of Missouri and private higher education, he is retired from the U.S Army after 30 years of service with the rank of Colonel. The Executive branch is responsible for legislation, coordination with local and Federal governments, newsletters, news releases and public information. The Executive Branch of SEMA consists of the Director, a Principal Assistant, Information Technology, Geographical Information System, Public Information, a Statewide Volunteer Coordinator and clerical support. The Director coordinates with other state agencies on state legislation relating to emergency preparedness, earthquake issues and floodplain management and monitors federal legislation. He is responsible for the day-to-day operations of SEMA, which is housed in the Department of Public Safety under the Missouri Adjutant General's Office. During an emergency, the SEMA Director reports directly to the Governor's office. He chaired the Governor's Task Force on Floodplain Management. The director is the chairman of the Central United States Earthquake Consortium (CUSEC), and a member of the National Emergency Management Association (NEMA).

    Glossary of Terms
    The responsibility for enacting laws in Massachusetts rests primarily with the state legislature, formally known as the General Court. It is divided into two branches: a 160-member House of Representatives and a 40-member Senate. The two legislative branches work concurrently on pending laws brought before them. Lawmaking begins in the House or Senate Clerk's office where petitions, accompanied by bills, resolves, etc., are filed and recorded in a docket book. The clerks number the bills and assign them to appropriate joint committees. There are 21 of these committees, each responsible for studying the bills which pertain to a specific area (i.e., taxation, education, health care, insurance, etc.). Each committee is composed of six senators and eleven representatives. The standing committees schedule public hearings for the individual bills, which afford citizens, legislators and lobbyists the opportunity to express their views. Committee members meet at a later time in executive session* to review the public testimony and discuss the merits of each bill before making their recommendations to the full membership of the House or Senate. The committee then issues its report, recommending that a bill "ought to pass" or "ought not to pass" and the report is submitted to the Clerk's office.

    Chairman Burton, Congressman Waxman, Members of the Committee: Good Morning. I welcome this opportunity to present testimony on behalf of the Department of Justice at this hearing regarding the history of congressional access to deliberative Department of Justice documents. At the outset, I wish to remind the Committee of the Department's request to meet with the Committee about the Boston documents. It was and remains our hope that, in such a meeting, knowledgeable officials could confer with you about the nature of the documents. Such a meeting offers the potential for the Committee's oversight inquiry to move forward expeditiously. Mr. Chairman, in preparation for this hearing I have made an effort to familiarize myself with the history of congressional access to deliberative Justice Department documents, and deliberative prosecutorial advice documents in general. I wish to clarify that the current dispute between this Committee and the Department of Justice pertains only to the narrow and especially sensitive sub-category of deliberative documents constituting advice memoranda regarding whether or not to bring criminal charges against certain individuals and advice memoranda to the Attorney General in connection with appointing a special prosecutor. This category of documents which the Committee has subpoenaed is a very small subset of all deliberative Department memoranda, and an even smaller subset of the total universe of information which is routinely requested by and provided to Congress.
