INTRODUCTION
The Law Reform Commission was established by the Law Reform Commission Act 1975 as a statutory body corporate to keep the law of the State under review and, in accordance with the provisions of the Act, to undertake examinations and conduct research with a view to reforming the law and to formulate proposals for law reform. By section 4 of the Act the Commission is required, in consultation with the Attorney General, from time to time to prepare for submission by the Taoiseach to the Government programmes for the examination of different branches of the law with a view to their reform. If such programmes prepared by the Commission are approved by the Government, then the Commission shall undertake an examination of and conduct research in relation to the subjects set out in the programme and, if the Commission thinks fit, formulate and submit to the Taoiseach proposals for the reform of the law.

For many years in Europe there has been discussion about the existence or non-existence and, as the case may be, the origin of European private law. The realisation of a European law of contract, for example, has progressed to an advanced stage, also due to the Principles of European Contract Law published in 1994. It is also common to classify and define other areas of private law with the designation 'European'. Does this This observation particularly applies to persons and family law. In Europe there are indeed a few treaties in force which have brought together a number of family law branches, both as regards substantive law and conflicts, but as regards content there is no similar legislation in the family law systems in Europe. The major part of persons and family law has thus far been considered - and in this respect little will change in the near future - to be a matter of national concern. Every EU Member State has codified its persons and family law or has, to a greater or lesser extent, extensively regulated it by law. This enactment of specific regulations and their application demonstrates mutual differences and similarities. To the latter belong, with certain exceptions, the equal treatment of men and women, the necessity of treating legitimate and illegitimate children equally, and the possibility of dissolving a marriage by means of divorce, for example. But European family law, that is to say, the common basic principles which underlie the institutions of family law in Europe, is as such still to emerge.

Note: The legal office of the California Department of Education prepared this information about the law governing compulsory education in California.
California's compulsory education law, Education Code Section 48200, requires that all children between the ages of 6 and 18 attend public full-time day school, and further requires that their parents or guardians send them to public school, unless they are legally exempt from this attendance requirement. The two principal exemptions occur when a child receives instruction (1) in a private full-time day school or (2) from a qualified tutor. Tutors are required to hold state teaching credentials for the grade level(s) taught, but teachers in private schools are not. In this context, the term home schooling is understood to describe a situation in which non-credentialed parents teach their own children, exclusively, at home. Sometimes, parents call their home a "private school," and sometimes they file an informational affidavit of the kind required to be filed only by private schools. They often claim that their children are exempt from public school attendance because private school teachers need not be credentialed. They are incorrect in this assertion, however, and their claim is inconsistent with state law. A review of the history of California's compulsory education law evidences an intent by the Legislature to exclude "home schooling," as described above, from the exemptions to compulsory public school attendance. Moreover, to conclude that such a home schooling arrangement is a private school would render the credentialed tutor exemption completely meaningless and ineffective, a result that the courts have rejected.

As generally understood, the term home schooling describes a situation in which non-credentialed parents (that is, parents who lack a valid California teaching certificate) teach their own children, exclusively, at home, often using a correspondence course or other types of courses. Defined in this way, home schooling is not authorized in California, and children receiving home schooling of this kind are in violation of the state's truancy laws. Parents are certainly free to supplement their children's public school education with home schooling if they so desire; however, home schooling may not legally be used as a substitute for public school education. Local school districts are responsible for ensuring that all children of compulsory school age in the district are either: (1) in attendance at a public school or (2) legally exempt from public school attendance requirements. Three legal choices are available in California to parents who wish to place their school-age children in a setting other than a public school classroom:

In addition, if a child inherits property, a guardian of the estate must usually be appointed to manage the child's property. Guardianship of the Estate Even if a child lives with one or both parents, a guardianship is generally required if the child inherits property worth more than $20,000. (Smaller inheritances can often be held in a "custodianship" under California's Uniform Transfers to Minors Act [UTMA], or can be distributed to the child's parents.) The guardian must file a petition in the Probate Court. There is a $193 filing fee (waived for those with very low incomes). A bond must also be purchased from an insurance company unless the money will all be deposited in a "blocked account" with a bank or brokerage. After the court appoints a guardian, an inventory and appraisal must be filed, and annual or bi-annual accountings must also be filed with the court until the child reaches age 18. A guardianship of the estate is not required if a gift or bequest of any amount is expressly made under the "Uniform Transfers to Minors Act" or if the gift is held in a trust.

    Transferring Children From One School to Another
    To transfer your child from the school he is currently attending to your private homeschool simply write a short letter to the principal of the current school to inform him of your intent. He is the only official you need to inform. This will enable him to remove your child from the school roll. Consequently they will no longer be looking for your child and will not report him as truant when he does not appear. Communicate with them in an error free professional letter on your school letterhead. If you do not have letterhead for your school, then an error free letter, neatly typed on plain paper will suffice. You should keep photocopies of all correspondence on file. Please see the sample letter below. You may also include in the letter a request for the transfer of your child's permanent school record to your school's address. Should you receive further contact from the Superintendent's office a simple letter reaffirming your previously stated intent is sufficient. This letter again can simply state that yes, indeed, you are teaching your children the "branches of education taught to children of corresponding age and grade in public school" in the English language. Your child is therefore in compliance with the Illinois Compulsory Attendance Law. Should you receive further contact from the school district by phone or in person, we would encourage you to require them to address their concerns to you in writing. This will give you opportunity to respond in a confident manner, affording you the opportunity to seek counsel from others. Also, written correspondence would be less likely to contain false or exaggerated information. Although there is no guarantee, some have received letters asking for home visits, also to approve their curriculum, class schedule, or school calendar. All of these requests are outside of the requirements of the law.

Illinois law requires that students between the ages of 7 and 16 attend a public school, or else attend a private or parochial school where the branches of education are taught in the English language to children of the same age and grade as in the public schools. In 1950, the Illinois Supreme Court ruled that homeschools are to be considered as private schools. In "People vs. Levisen" the court ruled that a private school is: "a place where instruction is imparted to the young
    . . . the number of persons being taught does not determine whether a place is a school." In 1974, the US District Court stated in the case "Scoma vs. Chicago Board of Education" that the "Levisen" decision was "reasonable and constitutional." So, as long as you are teaching the branches of education in the English language, at the proper level for your child, then you are complying with the laws of Illinois concerning education. In Illinois, you enjoy the freedom to shape your school day and your curriculum for your children's specific needs and talents. Illinois government does not require testing, evaluation, or special oversight.
