Department of Justice SPECIAL PROGRAMS A. WITNESS PROTECTION SECURITY AND BENEFIT PROGRAM This program was launched by the Department pursuant to R.A. 6981 dated 21 April 1991 for the purpose of protecting important witness and granting them certain rights and benefits to ensure their appearance in investigative bodies/courts; thus providing a more effective administration of justice. Recently, the program has been decentralized to the Regional Prosecution Offices so that witnesses from the provinces need not come to Manila. They can now file their applications directly with the Regional State Prosecutors. B. VICTIM COMPENSATION PROGRAM The program, administered by the Board of Claims, was established pursuant to R.A. 7309 dated 30 March 1992 for the purpose of granting compensation to the victims of unjust imprisonment or detention and victims of violent crimes. Said victims are now provided with the proper venue where they can seek compensation through an expeditious and less tedious administrative procedure, for the immeasurable pain and wrong they have unjustly suffered. Although the compensation provided for by law may only be a token amount, it is at least a way by which the State can show its genuine concern for these victims.

Newsletters Misdemeanors Quiz: Will I Be Arrested? Misdemeanors are less-serious crimes. They are generally punishable by a fine or incarceration in the county jail for less than one year. The prosecutor does not usually convene a grand jury to investigate and charge misdemeanor offenses, although such charges can be generated along with felonies. Most Misdemeanors are charged by written indictment and in many jurisdictions, poor defendants are not entitled to a court-appointed lawyer. Often, Misdemeanors are handled by special courts with abbreviated procedures. For instance, the defendant may have to request and pay a fee in order to get a jury trial. Misdemeanor traffic offenses may have pre-set penalties in the form of scheduled fines. The consequences for misdemeanor convictions are generally less severe than for felony convictions. A person with a misdemeanor crime on his record may still be able to serve on a jury, practice his or her profession, and vote. Serious felonies like assault and sexual abuse may have misdemeanor charges as part of the statutory scheme. For instance assault causing severe bodily injury is a felony, but simple assault that leaves no lasting injury is a misdemeanor. Likewise, rape is a felony, but lascivious acts is a misdemeanor. No state has enacted a law prohibiting employers from discriminating against all domestic violence victims (although New York City does have such a law). Several states, however, have passed laws that prohibit employers from firing or retaliating against domestic violence victims in certain circumstances STATE AND LOCAL LAWS CALIFORNIA: CAL. LAB. CODE § 230 (as amended by 2002 Cal. Stat. 275, enacted Aug. 26, 2002). This law prohibits employers from discharging, discriminating or retaliating against an employee who is a victim of domestic violence or sexual assault for taking time off to obtain or attempt to obtain judicial relief to help ensure his or her health, safety or welfare or that of his or her child. The term "child" as used in the Laws of War The Child Combatant ... Introduction Over the years, my views on child soldiers have changed. Formerly I felt sorry and angry about the fate of child soldiers. Now I feel sorry and fearful. I first met a child soldier in 1979, in Kampala, Uganda, soon after the overthrow of dictator Gen. Idi Amin Dadda. Later, during the 1980s, use of child soldiers, otherwise known as 'Kadogos'(-the little ones-) in Uganda, became a common phenomenon. Many of the "Road Blocks"(Checkpoints) through out Uganda were manned by child soldiers. By 2nd September 1990, when the Convention on the Rights of the Child came into force, participation of children in armed conflict in Uganda had become almost state practice. Today, children are found in the ranks of government soldiers and guerrilla movements. In the course of my legal practice in Uganda, I travelled extensively by road, to many parts of the country, passing through numerous road blocks manned by Kadogos. These Kadogos were simple kids, they appeared harmless, particularly when playing cards by the road-side, or playing with whatever toys they could lay their hands on. On the other hand, these child soldiers were unpredictable, wild, ruthless and dangerous. It is this contradiction - the appearance of an harmless and normal child, who likes to play with toys, on the one hand, and a dangerous death machine, who kills with pleasure and glee, on the other hand, that horrified me.

Glossary Of Terms 3.4 Legal Issues Review The legal review focused on key materials identified by Canadian experts on health law and on materials located in our literature search. This review begins with a short section on definitions. We then review the two sources documents and several other pertinent items. 3.4.1 Medical Law - definitions and principles Under Canadian law a physician may be subject to criminal as well as civil liability when causing death or bodily harm to another person. Everyone who undertakes to administer surgical or medical treatment to another person or to do any other lawful act that may endanger the life of another person is, except in cases of necessity, under a legal duty to have and use reasonable knowledge, skill and care in so doing. Everyone who undertakes to do an act is under a legal duty to do it if an omission of the act is or may be dangerous to life (Canadian Encyclopedic Digest, 1994, Ref.106). The law of negligence governs the majority of actions brought against hospitals, doctors and healthcare professionals. The term malpractice is often used to describe this type of action (Picard and Robertson, 1996).
