Just remember this: A lawyer is an officer of the court FIRST! If you are guilty, or have no case, a lawyer is ethically obligated to represent you as just that - guilty! Sure they'll still take you money and go through the motions, but you will LOSE! Lawyers are ethically sworn to represent the TRUTH. Don't kid yourself into believing that they are being paid to win or 'get you off'. It won't happen, unless your civil rights were clearly violated (and of coarse can prove it).. It's unlikely you can pay them enough to be worth the risk of being disbarred.

This gives users—especially users who read on airplanes or in hotels—a more convenient option than using larger notebooks with limited battery power to read their eBooks. With Advanced eBook Processor, these PDF files can be decrypted, opened, and used without any of these restrictions.     The rule of law underlies a constitutional democracy, and one of the critical components of the rule of law in a constitutional democracy is neutrality. In a telepress conference to Slovenian judges, U.S. Supreme Court Justice Anthony Kennedy talks about how the judicial branch of government must guarantee the neutrality of the rule of law, while maintaining a delicate balance between judicial ethics and independence. Judicial ethics are closely linked to judicial independence and it's hard to talk about one without talking about the other. The law is a promise. The promise is neutrality. If the promise is broken, if there is no neutrality in the enforcement, in the administration, in the interpretation of the law, then the law as we know it ceases to exist.... Judicial independence is closely related to neutrality. It is the duty of the judiciary to insist that the other branches of government give to the judiciary the resources and the support and the defense that the judiciary needs to do its job. But it is difficult to convince the other branches of government, in part, because some legislators think judges have an easy job. Legislators are reluctant to raise judges' salaries or to appoint more judges. It is also difficult because resources are scarce, and legislators have to be concerned with building hospitals and schools and roads.... But a functioning legal system is as important to a growing economy and to a progressive society as are hospitals and schools and roads. And so, it is the duty of the judge to explain that the courts and the law are an important part of the capital infrastructure of any society.

There are other cited court cases which deal with the analysis of the personality from a handwriting exemplar in the areas of the mental and emotional states of the writer. In the field of personnel screening... It is important to follow the guideline that any reports generated from the analysis of an applicant's handwriting will not be the sole criterion for making a decision regarding employment. The information obtained should be utilized in future interviews to ask specific questions about personality traits which may or may not impact the person's ability to discharge the requested duties. Questions can also be fashioned from the reports and used in reference checking relative to the applicants experience/abilities for accomplishing prior jobs. The process of analyzing a person's handwriting for job related characteristics usually does not involve a face to face meeting with the applicant. Information sent to the analyst usually does not include age, sex, race and/or religion.

3.4 Legal Issues Review
The legal review focused on key materials identified by Canadian experts on health law and on materials located in our literature search. This review begins with a short section on definitions. We then review the two sources documents and several other pertinent items.
3.4.1 Medical Law - definitions and principles
Under Canadian law a physician may be subject to criminal as well as civil liability when causing death or bodily harm to another person. Everyone who undertakes to administer surgical or medical treatment to another person or to do any other lawful act that may endanger the life of another person is, except in cases of necessity, under a legal duty to have and use reasonable knowledge, skill and care in so doing. Everyone who undertakes to do an act is under a legal duty to do it if an omission of the act is or may be dangerous to life (Canadian Encyclopedic Digest, 1994, Ref.106). The law of negligence governs the majority of actions brought against hospitals, doctors and healthcare professionals. The term malpractice is often used to describe this type of action (Picard and Robertson, 1996).

Forensic science is the use of science in the service of the law. Sciences used in forensics include any discipline that can aid in the collection, preservation and analysis of evidence such as chemistry (for the identification of explosives), engineering (for examination of structural design) or biology (for DNA identification or matching). A forensic scientist is expert in any technical field and can provide an analysis of the evidence, witness testimony on examination results, technical support and even training in his or her specialized area. Why is Forensic Science important?
Analysis of forensic evidence is used in the investigation and prosecution of civil and criminal proceedings. Often, it can help to establish the guilt or innocence of possible suspects. Forensic evidence is also used to link crimes that are thought to be related to one another. For example, DNA evidence can link one offender to several different crimes or crime scenes (or exonerate the accused). Linking crimes helps law enforcement authorities to narrow the range of possible suspects and to establish patterns of for crimes, which are useful in identifying and prosecuting suspects.

Background
On I June 1997 the ACT Government introduced legislation that requires certain professional groups to report non-accidental physical injury to children and /or child sexual abuse. Mandatory reporting has been the subject of vigorous debate throughout Australia and the world. The strong arguments in favour of mandatory reporting centre around the belief that some people, through their occupations, have special information about children. Mandating these people to report suspected abuse will lead to increased help for children who may otherwise suffer serious harm. The decision to mandate the reporting of child abuse in the ACT is an expression of the Government's commitment to the United Nation's Convention on the Rights of the Child . It is also recognition of the vulnerable status of children and the special protection they need in law. Mandatory Reporting, however, is only one part of a greater strategy to prevent child abuse. Responsibility for keeping children safe from harm and providing for their long term well being, falls on all adults, both as family members and as members of the community. A well informed body of professionals along with a community willing to share responsibility and provide support, will result in better services for children and families and a safer environment for our children.

In framing this Code, the Working Party has taken account of the Civil Procedure Rules (CPR) and the Practice Directions as they exist on 1 December 2001, together with any case law on their interpretation. The Code of Guidance is designed to help experts and those instructing them in all cases where CPR applies. Scenario: What is proper treatment of mental health patients facing criminal charges?
Recently, a psychiatric patient was accused of causing the death of a bystander by pushing her in front of a train. Assuming that the patient has received some treatment since the incident, is it ethical for a physician to suspend therapeutic medication so that a jury can witness the extent of a patient's impairment at the time of the incident? Reply: In responding to the question, a brief historical review is useful. A patient's right to refuse psychiatric treatment has evolved as a matter of public policy and state statutes. Historically, voluntary patients have always had the right to refuse treatment. Patients committed involuntarily, however, as a result of their commitment status, did not enjoy the same freedom of choice. I receive many queries from college students interested in pursuing forensic psychology as a career. This page answers many of these students' basic questions. Further resources are listed at the bottom. Forensic psychologists are licensed clinical psychologists who specialize in applying psychological knowledge to legal matters, both in the criminal and civil arenas. Forensic psychology is an emerging sub-discipline of psychology, with its own professional organizations, training programs, and research journals. Legal issues in which forensic psychologists are frequently involved include the mental state of criminal defendants (insanity, competency, etc.), witness accuracy, jury behavior, child custody/family law, violence risk prediction, mediation/dispute resolution, discrimination, civil damages, social science research (e.g., recovered memory) and civil commitment. Forensic psychologists may be found in academia, public service, and the private sector. Forensic psychologists are akin to psychological detectives. In other words, the work involves a strong investigatory component. We must compare data from multiple sources in order to test alternative hypotheses. The emphasis is on written reports and court testimony that are scientifically valid and can withstand scrutiny in the adversarial environment of the courtroom.
