BRIEFING PAPER ON LEGAL ISSUES AND WITNESS PROTECTION IN CRIMINAL CASES
CHAPTER SEVEN: WITNESS'S RIGHTS v. ACCUSED'S RIGHTS
There is little explicit acknowledgement in domestic law of the potential conflict between the rights of the accused and the position of witnesses. It is doubtless assumed that the latter, as part of the criminal justice process, are afforded adequate protection by the police pre- and post-trial, and by the bench (and possibly the Crown) during the trial. However where such protection is forthcoming it is at the discretion of one or more of those agencies. The lack of guidelines, whether in statutory form or as a code of practice, leads to a variable and necessarily uncertain level of protection which is unsatisfactory. In European Law all of the case law involves accused persons as applicants and the focus is on their rights under Article 6 generally and Article 6 (3) (d) in particular, which requires "equality of arms" between the prosecution and the defence in relation to the attendance and examination of witnesses. Witnesses are given no rights under Article 6 and neither are complainers, whether witnesses or not. Article 6 is concerned only with persons accused of crimes. However, as already indicated above, some attempts have been made in the case law to acknowledge the vulnerability of particular witnesses and their need for protection in particular kinds of crime. Case law illustrates the overriding general principle that the accused should have "the right of confrontation" but also that such right is subject to some modification in certain circumstances. In particular, certain categories of witness, as outlined in the European cases already noted, may attract anonymity or other protective legal measures.

LEGAL ISSUES IN TAKING
TAPE RECORDED WITNESS STATEMENTS
By Ralph Thomas
STATEMENT PREFERENCES
A fellow member on the private-eye mailing list recently posted a message concerning the right way to open a recorded witness statement and what preferences should be used. This was in respect to his lawyer client pointing these things out as problems with the recorded statement:
My lawyer client felt that the problem I had with my preface was.......
A. That I did NOT offer the witness an opportunity to provide a written statement in lieu of an audio recording....on the recording itself.
B. That I did not record an advisory informing the witness that he was under no obligation to speak to me.
C. I did not TWICE seek the wit's specific consent to the statement.
When he first told me these things, I thought, like Julius thought, that something must have changed somewhere..... so I asked the other lawyer for his opinion. Like I reported in my orginal post... he did not see anything wrong with the way I was doing things. And once again, like Julius, I am still wondering if there has been a new decision..... or was my lawyer client just overly cautious.
Note that most insurance adjusters use this in their statement:
".......and I have your permission to tape record this statement?"

AUTOMOTIVE LAW...Continued
Dear Woman Motorist Automotive Law: A woman ran a yield sign and totaled my '94 Dodge Intrepid. My husband was driving and my 15-year-old son was in the passenger seat. It banged up my husbands knees good but didn't break anything. Pretty much the same with my son. I still owed $8,400. on my car. My question is what do I do to insure that I have transportation to work if they don't want to pay off my car and give me enough for a down payment that will get my payment in reach of my budget Thanks for your help. Perry Attorney Steve Swann's Answer Dear Perry: You really have asked two questions. First, how do you cover your "loss of use" if you and the insurance company cannot agree on a "fair market value." The second question seems to be "how does the insurance compute fair market value?" Loss-of-use rules are established under state law. You will need to contact a local attorney familiar with insurance, personal injury, tort law, etc. I would guess (and this is only a guess) that if you can show the insurance company is being unreasonable, and you incur rental car expenses, you may be entitled to their refund. The more important question is "what" do you get back when a car is totaled. The standard is fair market value (FMV). Since insurance companies tend to "low-ball" claimants so as to pay out as little as possible, you may want to get an appraisal to determine the fair market value of the car. Photographs and witness comments are helpful to show the car is more valuable than what the National Automobile Dealers Association (NADA), Kelly Blue Book, or other books quote. The insurance company is not required to put you into a new car by paying off the existing loan and kicking in several thousand dollars to boot. Again the standard is FMV.

About Human Rights in the Workplace
Introduction Human rights law entitles every Canadian to equal opportunity to employment and the right to work each day free of discrimination and harassment. The British Columbia Human Rights Code prohibits discrimination in employment advertisements , discrimination in wages , discrimination in employment , and discrimination by unions and associations Discrimination does not have to be intentional to be illegal under the Code . As well, it is an employer's responsibility to maintain working conditions free of discrimination and harassment, regardless of whether the employer is the cause of the discrimination or not. Those working for federally regulated employers are subject to the Canadian Human Rights Code , which prohibits virtually the same workplace discrimination as its B.C. counterpart. For specific information, federally regulated employees should consult the

    Decree absolute :
The decree absolute is the legal end of a marriage that allows the two individuals to legally remarry. It usually follows the decree nisi, which is issued six weeks beforehand, but in modern divorce proceedings this has been replaced by a final divorce order.
    Decree nisi :
The decree nisi is the final part of the divorce process which officially terminates the marriage. In legal terms, a couple are still married until the decree nisi has gone through and becomes decree absolute. This has now been replaced by a single final divorce order in modern divorce proceedings.
    Defamation :
Defamation is the publication of a statement about an individual that is published with the intention to tarnish or reduce their public reputation. In England and Wales, a defamatory statement comes in two forms: a permanent defamatory statement called libel , and a non-permanent defamatory statement called slander . Scottish law regards both forms of defamation as one. Learn more about the differences between Scottish and English legal systems in the Crime Fighters section.

Frequently Asked Questions in Marriage and Family Counseling
Many counselors will work their whole careers without ever being called to testify in court, but in marriage, family and child practice that isn't likely. Child welfare issues, divorce, abuse, neglect and other issues can land the counselor/therapist with a subpoena or court order. Here are some common legal and ethical questions asked by marriage and family practitioners, but every counselor can benefit from the answers. Q. I have been seeing this couple for several months, and they have decided on a divorce. The wife wants me to testify for her in the hearing, but the husband doesn't. What should I do? A . If you do not have prior written permission from both parties, you should refuse to testify and explain your reasons. Check your state law to ascertain your legal position. If you are subpoenaed to testify and bring your documents, show up at the specified time with all documentation and ask for the judge to rule on the issue. If the court orders you to testify, then you are legally required to do so. Legal consultation is advised for all situations involving subpoenas. To avoid both legal and ethical dilemmas, it is important to explain that as a marriage and family counselor the couple or the family is considered to be your client, rather than any individual within the unit. To reduce any later confusion, this should be in writing in your disclosure form and given to your client(s) before counseling begins.

Do's and Don'ts: Being a Witness THE DO's DO take a subpoena seriously. It has the force of a court order. That doesn't mean, by the way, that a judge has actually taken an interest in you (they are usually prepared by an attorney for a party) but a judge will be annoyed if you ignore a subpoena.

    http://www.ojp.usdoj.gov/ovc/publications/infores/etedv/incorp.htm
Domestic Violence Legal Issues Should be Incorporated Throughout Law School Curricula
Domestic violence legal issues should be incorporated into law school curricula as a core component of legal education. It may be easy to understand the benefits of raising these issues in clinical programs, which train students to represent or assist victims in the community. A more subtle need, however, is to alert lawyers to the ways in which domestic violence issues crop up in seemingly unrelated fields of law. Lawyers who practice any kind of family, criminal, tort, financial (including wills, trusts and estates, and tax law) or poverty law are likely to have cases complicated by domestic violence. Understanding how to spot domestic violence issues will assist lawyers to represent clients properly. Therefore, these issues must be raised not only in specialized clinics, but also throughout the curricula. Domestic Violence Legal Issues Should Be Raised in Core Curriculum Courses
Historically, domestic violence issues have not been raised in law school courses or addressed in mainstream legal journals. Traditional law school textbooks do not include domestic violence issues, and many law school professors do not incorporate domestic violence issues into their courses. Failure to address these issues penalizes all students. Regardless of the professional track a student chooses, it is likely that he or she will be faced with legal problems related to domestic violence as a practicing attorney. Since all students will benefit from an understanding of domestic violence issues, it is necessary to incorporate these issues into core curriculum courses.
