Making Our Immigration System More Secure
December, 2001 The terrorist attacks of September 11 have presented America with a challenge. Our government must do a better job of screening people who want to come to the U.S. to do us harm. At the same time, we must preserve our tradition as an open society and a nation of immigrants. Some in Congress would have us turn our backs on our traditions. They have proposed legislation that would isolate America, but would do little to isolate the terrorists who threaten us. As the details of the terrorist plot have emerged, what has become clear is that any change in the way we manage our immigration system will have only a limited impact on our national security . Far more important is our capacity to collect and analyze intelligence. Unless we know who it is that seeks to do us harm and make sure that information is in the hands of the proper authorities, the immigration system will be unable to catch these individuals. Changes to the immigration system that will make us more secure involve, primarily, better access to and timely use of information collected by our intelligence agencies. To a lesser extent, systems that help authorities determine whether a person who came to the U.S. is complying with the terms of his or her visa might be useful should authorities become interested in a person

For more than a century, HIAS, the Hebrew Immigrant Aid Society, has had an extraordinary impact on millions of Jews. For generation after generation, HIAS has provided essential lifesaving services to world Jewry, through its mission of rescue, reunion and resettlement. As an expression of Jewish tradition and values, HIAS also responds to the migration needs of other people who are threatened and oppressed. Started in New York City by a group of Jewish immigrants who found sanctuary in the United States after fleeing persecution in Europe, HIAS offered food, shelter and other aid to countless new arrivals. Since its founding in 1881, HIAS has assisted more than four and a half million people in their quest for freedom. This includes the million Jewish refugees it helped to migrate to Israel (in cooperation with the Jewish Agency for Israel), and the thousands it helped resettle in Canada, Latin America, Australia, New Zealand and elsewhere. Paparelli The horrific events of September 11, 2001, and the ensuing days have produced anger, shock, sadness and compassion in peace-loving people around the world. President Bush has urged us all to get back to work and show the terrorists that we will persevere and prevail. Despite the heartbreak of the last several days, life and business in America must and shall carry on. This need to move forward raises issues and concerns for American employers and their foreign workers. At present, very little is known directly from the agencies in the Federal Government that administer our nation's immigration laws. This memorandum will provide some preliminary answers and suggestions on how to facilitate the needs of business, counsel foreign workers and their dependents, and anticipate the changes that likely lie ahead.

A critical document is the U.S. visa stamp in your passport. It is important to remember that obtaining a new visa stamp is never guaranteed. Now, more than ever, it is possible that you may experience delays at a U.S. embassy or consulate, regardless of your country of citizenship. Recently several US embassies overseas have changed their hours of operation and application procedures. Each US embassy can set its own particular application process. A federally mandated tracking system has been implemented by the Bureau of Citizenship and Immigration Services (formerly the Immigration and Naturalization Service) which will require the Harvard International Office (HIO) to submit information electronically about all F-1 and J-1 students and scholars to the Bureau of Citizenship and Immigration Services (BCIS). The new system, known as the Student and Exchange Visitor Information System (SEVIS), will affect all international students, scholars, and accompanying dependents applying for new visa stamps at U.S. consulates.

Hands that Shape the World finds that immigrant women are among the most vulnerable to exploitation, abuse, and human rights violations in the U.S. Assessing the state of immigrant women in the five years since the 1995 Fourth World Conference on Women in Beijing, China, this unprecedented review of conditions for immigrant women finds that the U.S. government has not only failed to protect the rights of immigrant women, but has implemented new legislation negatively impacting the well-being, health, employment, and family life of immigrant women. Hands that Shape the World, first released as part of a U.S. immigrant women's delegation to the "Beijing + 5" activities in New York City in June 2000, is an important contribution to the process of assessing progress on the Platform for Action set at the 1995 conference. Although the Beijing Conference made important strides in promoting international standards for women's rights, the particular challenges facing migrant women continue to be ignored, both at the United Nations level and by the U.S. government. The first Guild lawyers supported President Roosevelt’s New Deal, assisted the emerging industrial labor movement, and opposed the racial segregation policies of the American Bar Association and the larger society. During its 65 year history, the NLG has been an important part of the American people’s struggle for real democracy, for economic and social justice, and against oppression and discrimination based on race, ethnicity, immigration status, class, gender or sexual orientation.
