The Course: A practical application of the comparative method to the study of the law that gives the civil law system its name: the Civil Code. We will focus on black-letter rules applicable to institutions common to most civil codes in the areas of Family Law, Property, Contracts and Torts. The introduction will include a discussion of the comparative method in the context of our course, and an overview of the civil law, its historical antecedents, structure and interpretation. Students will write a paper on a topic related to our subject matter. The paper will be drafted in stages that will include several oral presentations in class. Comparative law is not a prerequisite. Text: Materials Handout. A Civil Code Supplement and reading materials will be included in this handout. Because of the large number of pages in the material, a copy charge may be required. Students must get two binders in which to keep their materials. Office Hours : I will have regular office hours on Mondays, from 2:30 to 4:30 p.m. and on Wednesdays, from 11:00 a.m. to 12:00 noon. My office is in Room 337. You may also see me after class or schedule appointments. My office telephone number is 392-2234. If you feel lost, or if you have doubts that cannot be resolved during class or during the period immediately following it, please do not hesitate to come and see me. CIVIL ACTION - The generic term used to describe court proceedings that are not criminal in nature. This includes lawsuits by private parties as well as those involving governments. Except in cases concerning civil contempt (actually a quasi-criminal matter) there is seldom a possibility of incarceration to the losing party. In most jurisdictions actions are divided only into two kinds, namely, criminal and civil. A criminal action is prosecuted by the state as a party, against a person charged with a public offence, for the punishment thereof. Every other action is a civil action.

To assist lawyers in this aspect of their practice, there are many different types of form books available. When using form books, one should keep in mind that they are all general in nature. Therefore, before using a form, extreme care should be exercised to make sure that the language is entirely suitable for the purpose for which it is to be used. This pathfinder will look at two different categories of Florida legal forms: transactional forms such as for wills, contracts, sale of goods, and formation of business entities; and those for pleading and practice (litigation) purposes. The following list includes sources of Florida forms updated on a regular basis. The list is not all inclusive. Use it as a starting point. (This list, for the most part, does not include form books which are not regularly updated. The forms in those books may or may not still be valid.     This Code applies to justices of the Supreme Court and judges of the District Courts of Appeal, Circuit Courts, and County Courts. Anyone, whether or not a lawyer, who performs judicial functions, including but not limited to a magistrate, court commissioner, special master, general master, domestic relations commissioner, child support hearing officer, or judge of compensation claims, shall, while performing judicial functions, conform with Canons 1, 2A, and 3, and such other provisions of this Code that might reasonably be applicable depending on the nature of the judicial function performed. Any judge responsible for a person who performs a judicial function should require compliance with the applicable provisions of this Code. If the hiring or appointing authority for persons who perform a judicial function is not a judge then that authority should adopt the applicable provisions of this Code. A.
