    Alexander Downer Discusses Fiji Government Issues, Cambodian Release
    A DOWNER :The Australian Government?s very concerned that the former Khmer Rouge Commander Chhouk Rin has been set free by a court in Phnom Penh. We need to look at the details of the judgement before we know what the technical legal issues really are although the suggestion at this stage seems to be that the judge has released Chhouk Rin on the basis of legislation which provided for amnesties for former members of the Khmer Rouge. But we still need to explore the detail including getting it translated into English before we can make any definitive, express any definitive view about that. I have instructed our embassy in Phnom Penh to make the strongest possible representations to the Cambodian Government to say that we are very concerned and very disappointed at what has happened. I have said both in Opposition and in Government that those who are responsible for the death of David Wilson and his two colleagues, one French and one British, should be brought to justice. One of those people Nuon Paet has been tried and convicted and is in jail although he's appealing his sentence. There are two others who were allegedly involved, one is Sam Bith and the other is Chhouk Rin. In the case of Sam Bith the court is still investigating the case and that we very much hope that his case will be brought before the Courts. And secondly in the case of Chhouk Rin I?ve said already we are pleased that he was brought before the court, we are deeply disturbed that he has now been released and the circumstances that he has been released without apparently a full hearing of the case. But as I said we need to get more detail before I can say much more about it.

    DOWNER: ...but the tragedy that has occurred, the soldier accidentally was killed. He wasn't killed by militias or killed in anger in any way. It was just an accident. And it's a very sad and tragic thing, and the government extends its deepest sympathy and condolences to his family, who have been notified. REPORTER : There'll be an inquiry (indistinct)? DOWNER: Yes, I understand there's going to be a board of inquiry conducted by the Defence Department, which will be an appropriate way to go. REPORTER: You're off to Samoa, I believe, yeah. Can you just explain what the purpose of that is, and your - I guess - feelings about the situation in Fiji at the moment? DOWNER: Well, I'm off to Samoa to a meeting tomorrow of all of the foreign ministers of the South Pacific forum countries. We'll be talking about two things: we'll be talking about Fiji and we'll be talking about the Solomon Islands. We have helped to broker a cease-fire in the Solomon Islands. That is proving to be very fragile. There have been two breaches of it so far. But we are continuing to work with the Solomon Islands authorities to try to get the - keep the cease-fire consolidated and peace talks going. With Fiji - the meeting tomorrow, doubtless, will express its outrage at governments being overthrown by gunmen. And we will obviously be arguing that we want to see a return of constitutional government and democracy in Fiji.

    The opposition says it deserves cabinet seats too
    A legal challenge to Fiji's five-month-old government is under way in the capital Suva, with analysts warning that defeat could prompt a nationalist backlash. The opposition Fiji Labour Party has brought the action before the appeals court because it claims it has been excluded from Prime Minister Laisenia Qarase's coalition government. Mr Qarase has said he will resign if the court finds against him
    Under the country's 1997 constitution, any party winning more than 10% of seats in parliament should also be given a place in the cabinet. The Labour Party won 27 seats in the 71-seat chamber in last September's election, yet was not awarded any cabinet posts. Labour's leader, former Prime Minister Mahendra Chaudhry, has said his party should have been given at least six of the 21 cabinet positions. The case highlights the continuing racial tensions which have dogged Fiji since Mr Chaudhry's government was brought down in a coup in May 2000.

    FIJI: Government to take constitutional appeal to Supreme Court
    Fiji's High Court has ordered the government to follow the letter of the constitution and invite members of the opposition Labour Party into the multi-party cabinet. The order follows a Court of Appeal opinion in February, which found Laisenia's Qarase's government to be in violation of section 99 of the country's 1997 multi-racial constitution. Labour leader Mahendra Chaudhry now claims he's no longer certain Mr Qarase has any intention of abiding by the decision of the courts. The reconstituted Supreme Court will now be asked for a final ruling. listen audio help Presenter/Interviewer: James Panichi.
    Speakers: Mahendra Chaudhry, deposed Prime Minister; Qoriniasi Bale, Fiji's Attorney General. PANICHI: There's more courtroom drama ahead, with the government announcing it will return to the Court of Appeal with a view to moving the case to the Supreme Court.
    That has left Mr Chaudhry unsure whether Mr Qarase will ever accept an unfavourable court decision.

    8 September 1999 Suva: Greenpeace Pacific welcomes today's statement by the Fiji Goverment in protest of the current plutonium fuel (MOX) shipment through the region. Greenpeace is urging the Government to go further, and demand that the Pacific Teal and Pacific Pintail not enter Fiji's Exclusive Economic Zone. "The New Zealand and South African governments asked for a similar undertaking and received assurances that the Pacific Pintail and Pacific Teal would not enter their EEZs. We believe Pacific Island Governments should do the same, and that Fiji should lead the way," said Samantha Magick. In today's statement, Fiji Foreign Affairs Minister, Doctor Tupeni Baba called on the authorities concerned to stop the shipments. "We hope the Fiji Government raises this issue at next month's South Pacific Forum leaders meeting," said Magick. "Unless there is a strong declaration against future shipments, we fear that the South Pacific will become the "route of least resistance" and a highway for plutonium and nuclear waste shipments." "In the face of strong statements from Latin American and Caribbean countries, we believe the South Pacific is currently viewed as the 'route of least resistance'. This has to change," Magick said.

    Fiji enters into a new era with the May 1999 general election under a new constitution, which guarantees equality to all its citizens. The real challenge for Fiji and its new government now is to deliver the economic goods and services to its people. Economic prosperity and equality may be the key to creating a truly multiracial Fiji.
