Currently, attorneys in Connecticut may only be certified in the following areas: criminal law, (National Association of Trial Advocacy); civil trial practice, (National Association of Trial Advocacy); workers’ compensation law, (Connecticut Bar Association); business bankruptcy, (American Board of Certification); and consumer bankruptcy, (American Board of Certification). What would certification do for my practice? Certification is a way to distinguish yourself from your colleagues and to communicate your experience and competence to potential clients, as well as to other attorneys. Attorneys who have become certified as specialists may indicate that they have met the rigorous requirements of the Connecticut Bar Association’s certification program, making this certification a particularly desirable credential. Only attorneys who have been certified by a court approved certification program may indicate in advertisements and on letterhead that they are Board Certified Workers’ Compensation Specialists. Furthermore, certification is a good source for referrals; other attorneys feel more confident referring a client to a certified specialist.

Restatement of the Law Governing Lawyers Another important relationship between the Restatement and the ethics codes is that between decisional law and statutory law. The Restatement draws heavily on decisional law, while the ethics codes in almost all jurisdictions have the form and force of statutes, or at least administrative regulation. On subjects directly addressed in the ethics codes, the Restatement frequently tracks this statutory language literally, or at least without material change. In many instances, however, the Restatement significantly departs from the code formulations. Carefully considered and extensively debated, many of these departures simply clarify the underlying intention of the code provisions, while other departures seek to supersede drafting mistakes. Still other departures reflect the recognition that experience with the codes has revealed better resolutions on a variety of issues.

SURREPTITIOUS RECORDING OF TELEPHONE CONVERSATIONS We are often asked whether one party to a telephone conversation may tape record the conversation without the consent of the other party. A related question involves surreptitious recordings of employees or others by their employers or others using an extension telephone or similar device on the same premises. This area is subject to a patchwork of both federal and state regulation. Accordingly, it is necessary to look at both federal and state law; whichever law is more restrictive will generally be applicable. Federal law may preempt state law in certain instances. As noted below, an attorney should be consulted because of the complex interplay of different regulatory schemes. Federal Law The federal Omnibus Crime Control and Safe Streets Act of 1968, 18 U.S.C. § 2510 et seq., prohibits the willful interception of telephone communication by means of any electronic, mechanical, or other device without an applicable exemption. There are two principal exceptions: Federal Exceptions Consent In the absence of more restrictive state law, it is permissible to intercept and record a telephone conversation if one or both of the parties to the call consents (as long as the tape is not made for a tortious, criminal or otherwise illegal purpose such as blackmail). Consent means authorization by only one participant in the call; single-party consent is provided for by specific statutory exemption under federal law. 18 U.S.C. § 2511(2)(d).
