From the supplier: Cost control methods used by managed care plans are likely to result in increased litigation. The cases fall into two main categories: those involving denial of medical treatment through utilization review and those based on malpractice or deficient quality of care. Preemption of state law under the Employee Retirement Income Security Act (ERISA) adds further complexity to the issue. The issue of when a managed care plan is liable for denial of medical services has not been settled. Moreover, the structure of the parties' relationship can be decisive in determining ERISA preemption.
