A federal district judge has tersely dismissed a lawsuit against Sony , maker of the hit movie "Spider-Man," in which plaintiffs had contended that the film and its television commercials violated trademarks by digitally altering billboards for scenes set in Times Square. In a ruling issued late last month, Judge Richard Owen of the Southern District of New York wrote that it was questionable whether the digitally altered depictions of the billboards even warranted a trademark claim. Moreover, Judge Owen stated that even if there were trademark infringements, creating false or confusing messages for consumers, the movie scene would still be protected by First Amendment rights to free expression. The lawsuit was filed in April by owners of several Times Square buildings and outdoor advertising companies against the Sony Corporation of America and its various film units. The suit said Sony had violated trademark laws by making changes that included superimposing a USA Today ad on a Times Square billboard that in real life is for Samsung Electronics, a competitor of Sony of America's parent, the Sony Corporation, in Japan.

This morning, Chairman Young graciously agreed to fly over some of the abandoned mine sites to view first-hand the culm piles, acid mine drainage and subsidence all too familiar to Northeastern and Central Pennsylvanians and I think it made an impact. I'd also like to acknowledge my colleagues, Congressmen Paul Kanjorski and Tim Holden, who will both testify today, and Congressman George Gekas, who has submitted a statement for the record. Thank you, Congressman Kanjorski and Congressman Holden, for your determination and hard work to elevate this discussion and focus Washington's attention on the unmet reclamation needs of the anthracite region. I believe that by continuing to work in a bipartisan manner, we will prevail in creating greater awareness and national interest in reversing the scars of coal mining. Last but not least, I want to thank the witnesses who have agreed to testify today. I want to thank in particular Andy Skrip, from the Scranton Chamber of Commerce and Bernie McGurl, from the Lackawanna River Corridor Association who live and work in the 10th District and bring their many years of experience to the discussion. I'd also like to mention that former Congressman Joe McDade was asked to testify, but it just couldn't be worked out schedule-wise. Mr. McDade worked extremely hard during his 36 years in Congress to improve the lives of Northeastern and Northcentral Pennsylvanians. But he also knows that there's a long way to go. Heats and features were lengthened for the evening, and the lineup for the feature was based solely on IMCA points earned at the Southern Iowa Speedway. This method for lining up the cars made for some very exciting and close racing. Heat race winners were Brian Sterling Brad Pinkerton and Kevin Booy in the stock car class. Kris Walker Scott Buehneman and Brad Stephens all claimed victory in the hobby stocks. Randy Schroeder and Jim Lynch were heat race winners in the modifieds. The stock car feature took to the track after each driver was presented to the crowd. Points leader Brad Pinkerton sat on the pole with Howard Gordon Jr. beside him. As they made their way to the white line, Pinkerton grabbed the lead.
