C'est ainsi qu'en 1988, Trent réalisa une cassette démo 3 titres avec entre autre une version de "down in it", pour un projet nommé Nine Inch Nails dans lequel il était le seul musicien. C'est aussi à ce moment là que Trent eu de sérieux problèmes avec son label TVT. Selon lui, il ne lui aurait pas offert tout ce qu'ils auraient du, spécialement au niveau de la promotion et des royalties, et surtout qu'ils essayaient d'influencer son travail. Cette dernière accusation avait plusieurs raisons, dont le fait qu'une version différente de down in it que celle choisit par Trent, avait été intégré à Pretty Hate Machine, et que Steve Gottlieb aurait demandé que Nine Inch Nails devienne plus "commercial". Si on ajoute à cela l'avis plus que mitigé que TVT a réservé à Trent quand celui avait ramené son premier album fini, on peut comprendre l'animosité qui commençait à apparaître. Quand Trent s'est mit à critiquer violemment TVT pendant ses concerts, on a comprit que la guerre frontale était ouverte... Le résultat fut que nine inch nails changea de label pour passer sur interscope, alors que TVT gardait les droits sur pretty hate machine et sur les singles qui en était sortis.
