From September 2002 it has been unlawful for schools and the LEA to discriminate against disabled pupils (and prospective pupils) in the provision of education and associated services in schools, and in admissions and exclusions. The governing body is ultimately responsible for the school's duty not to discriminate. The Disability Rights Commission (DRC) has issued a Code of Practice for Schools (Disability Discrimination Act 1995 : Part 4) which is now in all schools. The DDA requires schools and LEAs: The Act does not require schools to remove or alter physical features of the school as a matter of course in order to comply with the Act, but to make reasonable adjustments in order to ensure that pupils with disabilities are not disadvantaged. These studies also strongly suggest that the dropout rate among students receiving special education services significantly exceeds the dropout rate among the general school-age population. The St. Paul Public Schools conducted a retrospective examination of the records of 4,500 students in attendance between 1974 and 1977 who left school prior to graduation. They found that up to 80% of the youths who dropped out may have been eligible for special education services. Hippolitus (1980) cited the Bureau of Education for the Handicapped as documenting the dropout rate for special education students at five to six times the rate of youths without handicaps. IMPLICATIONS AND RECOMMENDATIONS The implications of these findings have special significance for educational policy and practice. More systematic procedures for identifying potential dropouts and better follow-through in providing comprehensive programs that retain students with handicaps must be addressed.

As you may know I am an advocate for blind people being an officer of the National Federation of the Blind of New Hampshire. I also serve on several committees and have been an active advocate for all persons with disabilities. Most importantly I am a disabled father of a disabled student. I have in "an up close and personal" way observed how the lack of full funding of special education has pitted neighbor against neighbor; school against parent; and ultimately a system against our very treasured offspring. Our disabled children. Our future. As resources are fought over many of our disabled children go without assistive technology, specialized instruction (like braille literacy), and a myriad of other necessities that would ultimately make each of our special needs children fully educated and independent adults. Often schools avoid meeting their obligations to identify, evaluate or "code" our children with disabilities because they fear the financial ramifications associated with meeting these obligations. Just as often costly litigation is the result. Our special needs children are caught in the crossfire.
