64. Law and Psychiatry: Rethinking the Relationship (Cambridge Paperback Library)

Editorial Review

Product Description
This book is about the competing images of man offered us by the disciplines of law and psychiatry. Michael Moore describes the legal view of persons as rational and autonomous and defends it from the challenges presented by three psychiatric ideas: that badness is illness, that the unconscious rules our mental life, and that a person is a community of selves more than a unified single self. Using the tools of modern philosophy, he attempts to show that the moral metaphysical foundations of our law are not eroded by these challenges of psychiatry. The book thus seeks, through philosophy, to go beneath the centuries-old debates between lawyers and psychiatrists, and to reveal their hidden agreement about the nature of man. Some attention is paid to practical legal and psychiatric issues of contemporary concern, such as the proper definition of mental illness for psychiatric purposes, and the proper definition of legal insanity for legal purposes. This book was first announced, for publication in hard covers, in the Press's January to July seasonal list. ... Read more

5-0 out of 5 stars The basic bible for Construction Claims
This work has long been the foundational Primer for attorneys, forensics consultants, owners, construction managers, contractors and design professionals who are dealing with construction claims. It broadly covers delay (by both owner and contractor), disruption, acceleration, differing site conditions, scope change, termination, claims against professionals, equipment costs, overhead including Eichleay, and lost profits. Other books dig deep into any one of these topics (William Schwartzkopf on calculating productivity, for example) but this one offers the basics on all of them; well researched, annotated with plenty of quotations from case cites.

I've taught over 300 public one-day classes on these topics and have recommended this book to every one of the 5,000+ attendees.Every construction-related office should have a copy.As long as we do Design-Bid-Build projects, this work will have a place on our reference shelves. And when we've finally moved fully to Design-Build, Lean and Integrated Project Delivery, we'll keep a copy around to remind ourselves of how complicated our construction lives once were.

Cushman, who passed recently, edited 36 books still sold on Amazon, every one an authoritative, but very readable treatment of its subject. His name on a legal tome is a green light to the lay reader that s/he can access and understand the material and be a better client; knowing their attorneys are likely consulting Cushman works as well. ... Product Description
Investment treaties, which grant special international protection to foreign investors and give them a means to enforce those rights against States in which they have invested, have become increasingly important in planning, executing and managing international investments. The Law of Investment Treaties explains the nature, history, and significance of investment treaties and their impact on international investors and investments, as well as on governments that are parties to them.

The international law governing trans-national investments has undergone a remarkable transformation in a relatively short time. The fundamental tool for effecting that transformation has been the investment treaty, in which contracting countries set down rules to govern investments by their respective nationals in each other's territories. They include the North American Free Trade Agreement, theEnergy Charter Treaty, and some 2500 bilateral investment treaties. This trend is bound to grow in the future. While differing in particular provisions, investment treaties all do two things: 1) they grant special protective rights to foreign investors, and 2) they provide for mechanisms that allow investors to enforce those rights, usually by international arbitration.

The Law of Investment Treaties examines the nature, history, and significance of investment treaties and their impact particularly on protected investors and investments, as well as on governments. Although the precise provisions of investment treaties are not uniform and some treaties restrict host country governmental action more than others, virtually all investment treaties address the same issues. Drawing on the growing body of arbitration decisions applying and interpreting investment treaties, this book examines in detail these common issues, including the scope of application, conditions for the entry of foreign investment and general standards of treatment of foreign investments (including increasingly common concepts such as "fair and equitable treatment" "national treatment", "most-favored-nation treatment" etc.). Monetary transfers, operational conditions, protection against expropriation and dispossession and compensation for losses are also explored. Salacuse also discusses dispute settlement, including negotiation, arbitration, conciliation, and judicial proceedings. ... Read more

    Editorial Review

    Product Description
As the EU's fundamental rights regime reaches maturity, this book offers the first full-length overview of the historical development and current role of fundamental rights in the law and policy of the European Union. It analyses both the institutional aspects (the place of fundamental rights in the EU legal order and their role in decision-making procedures) and substantive dimensions (the range and scope of rights recognized as part of EU law).

Part I traces the emergence of fundamental rights as a feature of the EU legal order, from the initial silence of the original Treaties to the development of fundamental rights as general principles of law safeguarded by the European Court of Justice, and the adoption of a number of legislative instruments linking the protection of certain fundamental rights to the establishment of the internal market.

Part II moves on to examine fundamental rights in the current landscape of EU law and policy. It analyses the constitutionalization of fundamental rights through Treaty amendments and the development of an area of freedom, security and justice among the Member States. It examines the role of the EU Charter of Fundamental Rights and of the Fundamental Rights Agency; and the relationship between the EU and the Council of Europe in the protection of human rights on the European continent.

Finally, Part III offers a critical analysis of the role of fundamental rights in the external relations of the EU.

As a whole, the book offers an ideal introduction to understanding the European Union as a human rights organization, suitable for use by graduate students, and an invaluable reference point for academics and legal practitioners needing an overview of EU fundamental rights law and policy. ... Very little has been written so far on people with disabilities in a general Islamic context, much less in reference to Islamic law. The main contribution of the book is that it focuses on people with disabilities and depicts the place and status that Islamic law has assigned to them.

The game-theoretic analysis of rights forms a rapidly growingfield of study to which this book makes an important contribution. VanHees combines the game-theoretic approach with the results and toolsfrom logic, in particular from the logic of norms. The resultingsynthesis between logic and game theory provides a firm foundation forthe game-theoretic approach. The analysis shows how different types ofright are related to the strategic opportunities of individuals and ofgroups of individuals. Furthermore, the book makes an importantcontribution to the theory of liberalism, in particular to the studyof the so-called `liberal paradoxes'. It demonstrates how theparadoxes resurface in the new decision-theoretic framework. In fact, they not only do so at the level of `ordinary' decision making, butalso at the level of constitutional decision making. ... Read more

During the 1990s, the international system underwent major changes with the end of the ideological divide that was the Cold War. At this time, the international system experienced a major movement with the widespread adoption of democratic systems leading academics to speak of an international victory for democracy, a third wave of democratisation and an emerging right to democratic governance. Within a short period of time, international law went from a position of supposed ideological neutrality to actively supporting the idea and practice of democracy. Concerns for democracy have been expressed in relation to membership to international organisations, international human rights law, trade conditionality, the process of recognition, multiple levels of governance, election monitoring and as a justification for the use of force. The essays in this collection will provide the reader with the key works in the debate about democracy in international law, demonstrating the wide influence democracy has had, the controversies that surround it and its importance for international law and relations. ...
