First, we must recognize that the Y2K problem has been known to the computer industry since the late 1980s, and has been discussed in the general media since at least early 1996. Therefore, the problem was and is foreseeable, and with the investment of sufficient resources and the exercise of due diligence, presumably avoidable. This is a significant factor for legal analysis of the Y2K problem because as a general matter, whether you are considering contract issues, tort issues (i.e., negligent damage to property or personal injury) or insurance recovery issues, a claimant has a legal duty to prevent foreseeable losses, and to minimize damages to the extent that they are avoidable. Failure to take action to avoid foreseeable losses can forfeit your rights to recover damages caused by Y2K problems, or the right to recover your losses from insurers. Second, although there have been forty to fifty Y2K-related lawsuits filed in the United States within the last year to eighteen months, there have been very few court decisions issued. Many of the key questions about Y2K legal liability have yet to be answered by any court and lawyers must analyze these questions on the basis of general legal principles. A third general observation is that "contingency planning" is a necessary part of every Y2K program because you cannot and will not find all the problems. Beyond being good practical advice, a business that fails to include contingency planning as part of its Y2K program and thereby suffers serious disruptions of services and operations, runs the risk of being found to have a program that was seriously deficient and lacking in due diligence.

Foreign legal researchers still face difficulty in doing Korean legal research due to lack of Korean legal resources in English. Extractions: Upgrading all of our hardware by replacing motherboards in the vast majority of our system is the first step we took to prepare for Y2K. Some, because of the age of the equipment or the complex work they do, will have to be replaced altogether. We must pay particularly close attention to the computers that run our ink-jet imaging and mailing department because the entire process is done electronically. The hardware/software currently in use by that division would render the data files from our customers next year unusable. Mailing and imaging is one of our fastest growing services-it is imperative we fix the problem now. On the upside, we have made progress in our preparation for the new millennium and feel confident we will be ready. The computer world, meanwhile, continues to explode offering more awesome ways to do business every day. We now have a corporate intranet allowing all our employees access to such things as company memos and announcements, our three websites, and our quality management system. The latter of these is extremely important because it houses all the information necessary for ISO-9002 compliancy. The forms are updated electronically and our employees browse them as needed. In addition, employees can access any of the ISO procedures and forms necessary (and believe me, there are many) to ensure compliancy and fill them out online. We are also working to expand our in-house system that currently allows employees to check on the status of jobs and make this same information available to our customers in a secure manner. (Scary thought, huh?)

You may think that only big business will be affected, but chances are that the problem may affect not only small to medium sized businesses but also individuals and households as well. 'Being affected' is only a simple way of putting it because you can be affected either as a person who has suffered loss or damage and you are seeking to find some remedies from somebody or you are that somebody who wishes to minimise the legal and economic risks that accompany these problems. What then is the Millennium Bug? Many computer systems are unable to cope with the change in dates from 1999 to 2000. The problem has arisen because computer programmers in the 1960s and 1970s represented years using only the last two digits (but not the century) in order to save computer space. This means that when the year 2000 arrives, computers may think that they have gone back in time to 1900 and therefore malfunction. Such a problem affects any electronic equipment containing a non-2000 compliant computer chip. While some equipment may continue to operate it may display incorrect dates.
