It is doubtless assumed that the latter, as part of the criminal justice process, are afforded adequate protection by the police pre- and post-trial, and by the bench (and possibly the Crown) during the trial. However where such protection is forthcoming it is at the discretion of one or more of those agencies. The lack of guidelines, whether in statutory form or as a code of practice, leads to a variable and necessarily uncertain level of protection which is unsatisfactory. In European Law all of the case law involves accused persons as applicants and the focus is on their rights under Article 6 generally and Article 6 (3) (d) in particular, which requires "equality of arms" between the prosecution and the defence in relation to the attendance and examination of witnesses. Witnesses are given no rights under Article 6 and neither are complainers, whether witnesses or not. Article 6 is concerned only with persons accused of crimes. However, as already indicated above, some attempts have been made in the case law to acknowledge the vulnerability of particular witnesses and their need for protection in particular kinds of crime. Case law illustrates the overriding general principle that the accused should have "the right of confrontation" but also that such right is subject to some modification in certain circumstances. In particular, certain categories of witness, as outlined in the European cases already noted, may attract anonymity or other protective legal measures.

That I did NOT offer the witness an opportunity to provide a written statement in lieu of an audio recording....on the recording itself. B. That I did not record an advisory informing the witness that he was under no obligation to speak to me. C. I did not TWICE seek the wit's specific consent to the statement. When he first told me these things, I thought, like Julius thought, that something must have changed somewhere..... so I asked the other lawyer for his opinion. Perry Attorney Steve Swann's Answer Dear Perry: You really have asked two questions. First, how do you cover your "loss of use" if you and the insurance company cannot agree on a "fair market value." The second question seems to be "how does the insurance compute fair market value?" Loss-of-use rules are established under state law. You will need to contact a local attorney familiar with insurance, personal injury, tort law, etc. I would guess (and this is only a guess) that if you can show the insurance company is being unreasonable, and you incur rental car expenses, you may be entitled to their refund. The more important question is "what" do you get back when a car is totaled. The standard is fair market value (FMV). Since insurance companies tend to "low-ball" claimants so as to pay out as little as possible, you may want to get an appraisal to determine the fair market value of the car. Photographs and witness comments are helpful to show the car is more valuable than what the National Automobile Dealers Association (NADA), Kelly Blue Book, or other books quote. The insurance company is not required to put you into a new car by paying off the existing loan and kicking in several thousand dollars to boot. Again the standard is FMV.

Child welfare issues, divorce, abuse, neglect and other issues can land the counselor/therapist with a subpoena or court order. Here are some common legal and ethical questions asked by marriage and family practitioners, but every counselor can benefit from the answers. Q. I have been seeing this couple for several months, and they have decided on a divorce. The wife wants me to testify for her in the hearing, but the husband doesn't. What should I do? A . If you do not have prior written permission from both parties, you should refuse to testify and explain your reasons. Check your state law to ascertain your legal position. If you are subpoenaed to testify and bring your documents, show up at the specified time with all documentation and ask for the judge to rule on the issue. If the court orders you to testify, then you are legally required to do so. Legal consultation is advised for all situations involving subpoenas. To avoid both legal and ethical dilemmas, it is important to explain that as a marriage and family counselor the couple or the family is considered to be your client, rather than any individual within the unit. To reduce any later confusion, this should be in writing in your disclosure form and given to your client(s) before counseling begins.

Understanding how to spot domestic violence issues will assist lawyers to represent clients properly. Therefore, these issues must be raised not only in specialized clinics, but also throughout the curricula. Domestic Violence Legal Issues Should Be Raised in Core Curriculum Courses Historically, domestic violence issues have not been raised in law school courses or addressed in mainstream legal journals. Traditional law school textbooks do not include domestic violence issues, and many law school professors do not incorporate domestic violence issues into their courses. Failure to address these issues penalizes all students. Regardless of the professional track a student chooses, it is likely that he or she will be faced with legal problems related to domestic violence as a practicing attorney. Since all students will benefit from an understanding of domestic violence issues, it is necessary to incorporate these issues into core curriculum courses.
