Isn't it something of interest to the birds... or maybe the attorneys? If you said 'Yes', think again!! Consider the internet provider in Lithuania or the one person startup in Canada who download the contents of your site onto their servers, change the headers, and are deriving commercial benefits from that content. Consider the professor in California or the faculty staff member in the UK who believe that they have all the justifications for copying your publication without attribution or authorization since they are using it only for non-commercial teaching purposes. How about the research lab director at a large northeastern United States university who firmly believes that he is right in making physical copies of your online content on their server for their testing purposes?

Extractions: The death penalty, or capital punishment, may be prescribed by Congress or any state legislature for murder and other capital crimes. The Supreme Court has ruled that the death penalty is not a per se violation of the Eighth Amendment's ban on cruel and unusual punishment. Furthermore, the Sixth Amendment does not require a jury trial on the sentencing issue of life or death. In the landmark case, Coker v. Georgia, 433 U.S. 584 (1977) , the Supreme Court ruled that the death penalty is a grossly disproportionate punishment for the crime of rape of an adult woman. The Court came to this conclusion by considering objective indicia of the nation's attitude toward the death penalty in rape cases. At the time, only a few states allowed for executions of convicted rapists. More recently, in Atkins v. Virginia , the Supreme Court used the same line of reasoning to rule that executions of mentally retarded criminals are "cruel and unusual punishments" which are prohibited by the Eighth Amendment The Supreme Court has established that for death penalty sentencing the sentencer's discretion be narrowly guided as to the circumstances that justify imposing the death penalty and that the sentencing process should be individualized.

FOR MORE INFORMATION ABOUT ERIC, CONTACT ACCESS ERIC 1-800-LET-ERIC ESSENTIALS OF LAW-RELATED EDUCATION: A GUIDE FOR PRACTITIONERS AND POLICYMAKERS is a statement of the goals and content of law-related education (LRE). Developed by the American Bar Association's Special Committee on Youth Education for Citizenship in 1995, ESSENTIALS OF LAW-RELATED EDUCATION concentrates on four areas: (1) subject matter and concepts; (2) instructional strategies and contexts; (3) skills; and (4) attitudes, beliefs, and values. Together, they provide K-12 students with active learning experiences that enhance their ability to explore rights and responsibilities under the law, confront and resolve disputes, and discuss and analyze public issues. This digest summarizes the original ESSENTIALS document. LRE has been defined as "education to equip nonlawyers with knowledge and skills pertaining to the law, the legal process, and the legal system, and the fundamental principles and values on which these are based" (Law-Related Education Act of 1978). LRE is typically understood to foster the knowledge, skills, and values that students need to function effectively in our pluralistic, democratic society based on the rule of law. Law-related educators strive to develop the active citizens our society requires: those who can understand, live in, and contribute positively to the civic communities to which they belong.
