Davis waited until the last possible day to act on the controversial pair of bills, the focal point of one of the Legislature's most riveting battles this year. He made repeated efforts to prevent the legislation from reaching his desk, then later negotiated with UFW representatives to limit the scope of the two measures he signed Monday. Under the companion billsSenate Bill 1156 and Assembly Bill 2596farm workers can ask the state Agricultural Labor Relations Board to impose mandatory mediation in cases where contract negotiations with growers have stalled, beginning in January. Extractions: Is Mediation Right for Your Company? Mediation has become a popular tool for businesses when disputes appear in the workplace. Even the Equal Employment Opportunity Commission (EEOC) is recommending that employers use mediation in an attempt to resolve conflicts in the workplace. In 1991, the EEOC began its first pilot program, using mediation in four different field offices. The program was so successful, that by 1994 the agency concluded that "mediation was indeed a viable mechanism for resolution of employment discrimination claims and recom- mended the implementation of a program." Soon after, the EEOC adopted a policy statement on alternative dispute resolution (ADR). Advantages to Mediation Disadvantages to Mediation One disadvantage to mediation is that most people don't like conflict. Roscoe clarifies, "Our number-one technique for dealing with conflict in our society is to avoid it. So, for these people, mediation isn't attractive because they have to deal with conflict; they can't avoid it. It is much easier for them to use the EEOC or a legal process to permit them to continue avoiding the conflict directly, because the third-party litigator carries the ball." Another downside to mediation is that there is no guarantee that the parties will reach an outcome. "Some people cannot work with this lack of certainty about a resolution," says Roscoe. "However, we are told that people feel that even if they don't get an agreement during the mediation, a lot of times they come to one later on, after they have had a chance to mull over what happened. But even if they don't come to an agreement, we find that mediation often makes their relationship more efficient as they go on, because they have actually communicated on some of the issues. They have narrowed some of the issues and have begun to understand each other a little bit better, even if they don't agree."

Extractions: by Mavis Anderson The majority of US citizens want a new US policy toward Cuba. Many want to end the embargo and reestablish normal relations with our neighbor Cuba. An encouraging small step was taken last year with the passage of the FY2001 agriculture appropriations bill. Language in this bill attempted to update US/Cuba policy to make it appropriate to a post-Cold War reality; yet the United States is long past due in crafting a new comprehensive, humanitarian, and effective policy toward Cuba. We are still waiting for the Bush Administration to issue regulations that would put the new policy into effect. It may be a long wait. Votes earlier in the year 2000 in both the House of Representatives and the Senate on sanctions imposed on Cuba were overwhelming victories in favor of a positive change in US policy toward Cuba. However, those victories were stolen in backroom deals among Republican leaders and in conference committee maneuvering. The will of a few members of Congress with special interests and with power subverted and overturned the will of the majority in Congressand the will of the US people, the majority of whom have repeatedly expressed their desire in a variety of national polls for relaxing sanctions toward Cuba. Now supporters are faced with the task of correcting the financing shortcomings of last year's legislation, as well as moving both the debate and the actuality concerning US/Cuba policy beyond surface actions to a comprehensive and deep change in policy. This task is made more challenging in the context of a Bush Administration that owes a great deal to the Cuban Americans of South Florida for the role they played in the presidential election results.
