The charges were renewed when an Indian pharmaceutical company recently offered poor countries an anti-AIDS medication at a fraction of its international price, which is said to have shown again the strengths of Indias 31-year-old patent rules. These recognise only manufacturing processes and not the products themselves. This allows local pharmaceutical companies to use strengths in basic chemistry to produce medicine molecules which are only slightly different from the original. Western drug majors call this piracy. According to a study released last year by the Pharmaceutical Research Manufacturers of America, the drug industry in the United States loses about $60 million annually on 20 drugs made this way in India. However, Indias top government health official, Javed Chowdhury, says there is nothing illegal about generic manufacture, at least until the year 2005. That is when India will have to start conforming to the World Trade Organisation (WTO) rules on intellectual property.

They have also asked for greater transparency in accounting disclosures by multinational corporations, besides obligations from home countries like prohibiting corrupt foreign practices by their corporations. A paper on investor and home country obligations drafted by India and submitted to the World Trade Organisation's (WTO's) working group on trade and investment has called upon the group to consider incorporating legally binding measures to ensure corporate responsibility and accountability on the part of multinational corporations. Co-sponsored by Pakistan, Cuba, Kenya and Zimbabwe, besides China, the paper has encountered stiff opposition from developed countries. The US, the European Union and Japan have warned that such measures would put a brake on investments in developing countries. Stung by criticism from opposition lawmakers in Parliament, who cited HIV statistics for India put out by UNAIDS , Health Minister C.P. Thakur has accused U.N. agencies of mis-reporting facts and creating confusion. "I am at a loss to understand how there can be so many different estimates by different U.N. agencies," an anguished Thakur told reporters at a specially called press conference Monday. He said he would "appeal to the U.N. agencies to realise the importance of these figures, which are about human subjects." Thakur said the National AIDS Control Organisation (NACO), which is supervised by his ministry, generates epidemiological data from field studies and it would be "advisable" for U.N. agencies to use these figures. The government's main objection is to figures in the latest UNAIDS report on the global HIV/AIDS epidemic, which show that 310,000 Indians died of AIDS in India in 1999. However, the report did not explain how the figure was obtained. Six years ago, NACO officially questioned the basis on which UNAIDS calculated that India then had 1.75 million people infected with the AIDS virus. The Indian AIDS agency also objected to the latest UNAIDS finding.

Interconnectivity between ISPs will be permitted only if both service providers have a licence to offer Internet telephony. This announcement indicates that the government has accepted the Telecom Regulatory Authority of India's (TRAIs) guidelines on Internet telephony, which prohibit wireline and wireless service providers from offering Internet telephony services. The governments announcement today comes after a lengthy regulatory consultative process involving TRAI, industry experts and representatives from consumer interest groups, fixed-line operators, mobile operators and ISPs. The government has, however, limited the scope of Internet telephony services. A call from a PC to a phone can only be made from India to an overseas location. Within the country, Internet telephony calls must be PC-to-PC. The Internet Protocol (IP)-based H.323/SIP terminals in India can also be used for Internet telephony within the country as well as abroad. ISPs are allowed to offer services within their serving areas depending on the category they belong to. ISPs are classified into three categories. Category A service providers may offer services on an all-India basis, Category B service providers may offer services in a particular state, while Category C service providers may only offer services in specific cities.

In February, the Telecom Regulatory Authority of India (TRAI) recommended that the government allow the cheaper, but inferior quality Internet telephony service without requiring the payment of any entry fees from ISPs. According to a publicly issued statement from the Indian government, "After examining the matter, the government has now decided to accept the (TRAIs) recommendations." Detailed guidelines would be issued on March 22. India is set to terminate the monopoly enjoyed by the recently-privatised Videsh Sanchar Nigam Ltd (VSNL) over the international calls business on April 1 and throw it open to unlimited private competition. The entry of private players is expected to sharply reduce overseas call charges from India, now among the highest in the world. Starting April 1, customers of ISPs could make voice calls from their computers to another computer within India and to a telephone abroad. This service will provide another much needed income stream for numerous ISPs, most of whom are losing money because of huge costs which they cannot recover from customers.

Theoretically the president possesses full executive power, but that power actually is exercised by the prime minister (head of the majority party in the federal Parliament) and council of ministers (which includes the cabinet), who are appointed by the president. The ministers are responsible to the lower house of Parliament (Lok Sabha) and must be members of Parliament. State governors are appointed by the president for five-year terms. States have either unicameral or bicameral parliaments and have jurisdiction over police and public order, agriculture, education, public health, and local government. The federal government has jurisdiction over any matter not specifically reserved for the states.
