CAPITAL PUNISHMENT AND MENTAL RETARDATION: LEGAL STANDARDS International Human Rights Law The cornerstone of human rights is respect for the inherent dignity of all human beings and the inviolability of the human person. These principles cannot be squared with the death penalty, a form of punishment unique in its cruelty and finality, and a punishment inevitably and universally plagued with arbitrariness, prejudice, and error. Recognition that the death penalty violates basic human rights has fueled a growing movement to abolish capital punishment around the world. Members of the European Union, for example, are united in their opposition to the death penalty in all circumstances, considering it an "inhuman, medieval form of punishment and as unworthy of modern societies." Out of the world's nearly 200 countries, 108 have rejected judicial executions in law or practice. Less than thirty carry out executions in any given year. Although the International Covenant on Civil and Political Rights (ICCPR) does not outlaw capital punishment outright, it specifically prohibits cruel and inhuman punishment and arbitrary executions, and limits capital punishment to "the most serious crimes." Forty-one countries have signed a Second Optional Protocol to the ICCPR by which they agree not to execute anyone and to take the necessary steps to abolish the death penalty. The practice of executing people of diminished culpability including people with mental retardation is particularly abhorrent. In recent years, the U.N. special rapporteur on extrajudicial, summary or arbitrary executions has received reports of the execution of people with mental retardation in only three countries Japan, Kyrgyztan, and the United States.

Extractions: by Nathan Lintner America's politically conservative represent a vast body of individuals whose overlapping philosophies unify them in an alliance of common interest. As intellectuals, patriots, scholars and common citizens, conservatives, while fighting to sustain essential freedoms, often advocate the advancement of personal responsibility and self-government. Yet while conservatives recognize the common ground that distinguishes them from other schools of thought, they also understand that every politically right winged individual does not hold the exact same opinions about politics and society. An occasional internal disagreement or friendly intellectual scuffle should therefore be expected (especially among passionate members) as the natural result of unhindered independent thought. Discussion is healthy in that it requires the individual to not merely assert his or her belief, but to explain the reasons why that belief is held. When formulating a personal philosophy, it is wise to remember that the most important positions and policies are inspired by deeply held convictions and result from a careful consideration of the larger picture. That capital punishment is not only wrong but also a non-Christian practice is certainly a dissenting proposition among conservative circles. General unpopularity however, is not a sufficient reason to abstain from arguing against that immoral and blasphemous institution.

The national office has therefore a task to source financial resources to support the campaign. The Embassy of Sweden made a contribution of ZK 57 312 500. 00 to the campaign. This report is an intermediate appraisal, to the Swedish Embassy as partners in to the campaign, on the project .It also gives a brief financial statement on the expenditure to date from the Swedish grant. The report covers the period between January, 1998 to end of June 1998. Activities executed to date include: Prooduction and Circulation of Awareness Material This process has already started. CCJP has compiled selected information material produced by Amnesty International and has circulated them to dioceses for use by diocesan CCJP commissions in their awareness programmes.The process of producing awareness materials still continues. CCJP is currently working on a flyer with simple campaign information on the question of capital punishment. Retreat for Catholics in Leadership The Chairperson of the Human Rights Commission was among those invited to participate in the above retreat. However, she received the correspondence late as she was out of the country at the time. She and her commission wrote to CCJP indicating that the Permanent Human Rights Commission has great interest in the subject matter. The commission therefore proposed a meeting with CCJP to explore mutual interests in the issue and see what possibilities are there for collaboration.The meeting between CCJP and the Human Rights Commission was held on Tuesday June 23rd, at 10:00 hours.
